'235 <br /> <br />NEW BUSINESS <br /> Commissioner Lentz introduced the following resolution the title of which <br />was read. <br /> <br />RESOLUTION APPROVING ISSUANCE OF BONDS BY THE <br />CABARRUS COUNTY INDUSTRIAL FACILITIES AND <br />POLLUTION CONTROL FINANCING AUTHORITY FOR <br />OILES AMERICA CORPORATION <br /> <br /> WHEREAS, The Gabarrus County Industrial Facilities and <br />Pollution Control Financing Authority (the Authority) has agreed to <br />assist in the financing under the North Carolina Industrial and <br />Pollution Control Facilities Financing Act (the Act) of an <br />industrial project by Oiles America Corporation in Cabarrus County; <br />and <br /> WHEREAS, the Authority intends to issue its Tax-Exempt <br />Adjustable Mode Industrial Development Revenue Bonds (Oiles America <br />Corporation Project), Series 1989 (the Bonds), in the principal <br />amount of $6,000,000 to be sold by Wachovia Bank and Trust Company, <br />N.A., as placement agent; and <br /> WHEREAS, under NCGS §159Co4 and Section 147(f) of the Internal <br />Revenue Code of 1986, as amended, the issuance of bonds under the <br />Act must be approved by the governing body of the county in which <br />the project to be financed under the Act is located; and <br /> WHEREAS, this Board has previously held a public hearing with <br />respect to the Bonds and adopted a resolution on September 18, 1989, <br />with respect to approval of the project to be financed with the <br />Bonds; <br /> NOW THEREFORE, the Board of Commissioners of Cabarrus County, <br />meeting in regular session at the Cabarrus County Courthouse, <br />Concord, North Carolina, on November 6, 1989, do the following: <br /> BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY <br />OF CABARRUS: <br /> The issuance of the Authority's Tax-Exempt Adjustable~ Mode <br />Industrial Development Revenue Bonds (Oiles America Corporation <br />Project), Series 1989, in the principal amount of $6,000,000 is <br />hereby approved. <br /> Commissioner Lentz moved the passage for the foregoing <br />resolution and Commissioner Melvin seconded the motion, and the <br />resolution was passed by the following vote: <br />Ayes: Commissioners William G. Hamby, Jr., James W. Lentz, Martha H. <br /> Melvin, R. Giles Moss, and Bill J. Simmons, Jr. <br />Nays: None <br />Not Voting: None <br /> <br /> At 9:20 P.M., Chairman Lentz opened the public hearing for the <br />consideration of the Cabarrus County Minority Contractors Participation Program <br />and asked if anyone were present who wished to speak for or against this <br />proposal. There was no one present to speak regarding this matter and the <br />public hearing was closed. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board adopted the following Policy, Guidelines and <br />Goals for Participation of Minority Businesses in Building Contracts. <br /> <br /> POLICY GUIDELINES AND GOALS FOR <br />PARTICIPATION OF MINORITY BUSINESSES IN BUILDING CONTRACTS <br /> <br /> I. General Statement of Policy <br /> A. It is the policy of the Cabarrus County Board of <br />Commissioners ("the Board") to provide minority persons equal <br />opportunity to participate in all aspects of county contracts for <br />the construction, renovation or repair of county facilities. <br /> B. It is further the policy of the Board to prohibit <br />discrimination against any person or business enterprise on the <br />basis of race, color, ethnic origin, sex, or religion and to conduct <br />its building contract programs so as to prevent such discrimination. <br /> II.
