No. 2009-04, § 6, 1-20-09) <br /> Sec. 50-37. - Penalty. <br /> Violation of section 50-32 shall be a class 3 misdemeanor and shall be punishable <br /> by a fine of up to $500.00 and or incarceration for a period of time as outlined <br /> in G.S. 15A-1340.20 et seq. Each and every entrance into a park or recreation <br /> facility, regardless of the time period between such entries, shall constitute <br /> a separate offense under this article. <br /> (Ord. No. 2009-04, § 7, 1-20-09) <br /> Sec. 50-38. - Severability. <br /> If any section, subsection, paragraph, sentence, clause, phrase or portion of <br /> this article is for any reason held to be unlawful, such decision shall not <br /> affect the validity of the remaining portions of this article. <br /> (Ord. No. 2009-04, § 8, 1-20-09) <br /> Sec. 50-39. - Signage. <br /> Each park and recreation facility should be posted to the effect that registered <br /> sex offenders are prohibited so that such persons and the general public are <br /> made aware of this article. Notwithstanding this section concerning signage, it <br /> shall not be a defense to a prosecution under this article that the park or <br /> recreation facility contained no signage. <br /> (Ord. No. 2009-04, § 9, 1-20-09) <br /> (G-4) Finance - Installment Financing Contract for Various School and County <br /> Projects - Public Hearing 6:30 P.M. <br /> Susan Fearrington, Finance Director, advised Cabarrus County plans to <br /> enter into one or more short and/or long-term installment financing contracts <br /> with the Cabarrus County Development Corporation or one or more third parties, <br /> for an amount not to exceed $128, 105, 000.00, to finance all or a portion of the <br /> cost of constructing and equipping a new high school, a new Performance Learning <br /> Center, a warehouse purchase and a parking deck in downtown Concord. She <br /> further advised a public hearing is required on the installment financing <br /> contracts for the projects described. <br /> Chairman Morris opened the public hearing at 7:21 p.m. The Public Hearing <br /> Notice was published on April 30, 2017 in The Independent Tribune. The Public <br /> Hearing Notice was also posted on the County' s website (www.cabarruscounty.us) <br /> on May 3, 2017 in accordance with Article 2, Administration, Section 2.1 (Use <br /> of Electronic Means to Provide Public Notices) of the Cabarrus County Code of <br /> Ordinances. <br /> Dr. Carol Spalding, Rowan-Cabarrus Community College (RCCC) , President, <br /> spoke briefly regarding funds budgeted for the purchase of real property for <br /> RCCC. <br /> Ms. Fearrington advised this installment financing contract does not <br /> include funding for RCCC. She advised funding for future RCCC projects, such <br /> as the advanced technology center, would have to be considered in a later debt <br /> issue. She also responded to questions from the Board. <br /> There was no one else present to address the Board; therefore, Chairman <br /> Morris closed the public hearing. <br /> No further action was required. <br /> (G-5) County Attorney - Request for Refund of Portion of Excise Tax on Real <br /> Property Transfer - Hearing 6:30 P.M. <br /> Richard Koch, County Attorney, reported Attorney Joshua Knipp, who <br /> requested the hearing for a refund of a portion of excise tax on a real property <br /> transfer, does not appear to be present. He advised this matter is up to the <br /> Board to decide whether to proceed with this matter based on what was sent <br /> originally, which is included in the agenda, or to continue the matter yet <br /> again. He reminded the Board that the last time the matter was continued was <br /> at Mr. Knipp's request. Mr. Knipp was notified the continued hearing would be <br /> held tonight. <br /> Mr. Koch stated he has not received a renewed or new request to continue <br /> the matter as of 5:00 p.m. today, and Mr. Knipp has not submitted any additional <br />
