August 21, 2017 (Regular Meeting) Page 3251 <br /> County staff has been negotiating lease terms for a wireless <br /> telecommunications tower site on part of the former fairgrounds property off <br /> U.S. 601. G.S. 160A-272 permits lease periods up to 25 years for the proposed <br /> use. The statute requires a resolution of intent to lease and advertisement of <br /> consideration of that intent to lease. <br /> There is a cemetery located on the property and the company negotiating <br /> with the County, Eco-Sites, has agreed to fencing that area as well as locating <br /> the tower such that it will not fall within the area should there be a collapse. <br /> UPON MOTION by Commissioner Kiger, seconded by Commissioner Shue and <br /> unanimously carried, the Board approved the resolution authorizing the execution <br /> of the lease and authorized the County Manager to finalize lease terms subject <br /> to review and revision by the County Attorney. <br /> Resolution No. 2017-15 <br /> RESOLUTION APPROVING LEASING A PORTION OF THE FORMER FAIRGROUNDS PROPERTY <br /> WHEREAS, Cabarrus County owns property between Union Cemetery Road and <br /> U.S. 601 commonly referred to as the former fairgrounds property; <br /> WHEREAS, the Board of Commissioners finds that portions of that property <br /> are not needed for any County or school building projects; and <br /> WHEREAS, the County has negotiated a lease for the construction of a <br /> wireless communications tower on part of the property that otherwise would <br /> remain unused; and <br /> WHEREAS, in consideration of leasing such space, the County will receive <br /> monthly lease payments that may benefit the public safety communications <br /> program; and <br /> WHEREAS, North Carolina General Statutes § 160A-272 authorizes the County <br /> to enter into leases of up to 25 years upon resolution of the Board of <br /> Commissioners adopted at a regular meeting after 30 days public notice; <br /> WHEREAS, the required notice has been published and the Board of <br /> Commissioners is convened in a regular meeting. <br /> THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br /> The Board of Commissioners hereby approves a lease of the County property <br /> described above for a period not to exceed 25 years and directs the County <br /> Manager to execute any instruments necessary to effectuate the lease. <br /> Adopted this the 21St day of August 2017 . <br /> /s/ Stephen M. Cabarrus <br /> County is the owner of the property on which this will be located. KCS negotiated <br /> terms of the lease and the County Attorney has reviewed and revised <br /> the document.
