August 21, 2017 (Regular Meeting) Page 3251 County staff has been negotiating lease terms for a wireless telecommunications tower site on part of the former fairgrounds property off U.S. 601. G.S. 160A-272 permits lease periods up to 25 years for the proposed use. The statute requires a resolution of intent to lease and advertisement of consideration of that intent to lease. There is a cemetery located on the property and the company negotiating with the County, Eco-Sites, has agreed to fencing that area as well as locating the tower such that it will not fall within the area should there be a collapse. UPON MOTION by Commissioner Kiger, seconded by Commissioner Shue and unanimously carried, the Board approved the resolution authorizing the execution of the lease and authorized the County Manager to finalize lease terms subject to review and revision by the County Attorney. Resolution No. 2017-15 RESOLUTION APPROVING LEASING A PORTION OF THE FORMER FAIRGROUNDS PROPERTY WHEREAS, Cabarrus County owns property between Union Cemetery Road and U.S. 601 commonly referred to as the former fairgrounds property; WHEREAS, the Board of Commissioners finds that portions of that property are not needed for any County or school building projects; and WHEREAS, the County has negotiated a lease for the construction of a wireless communications tower on part of the property that otherwise would remain unused; and WHEREAS, in consideration of leasing such space, the County will receive monthly lease payments that may benefit the public safety communications program; and WHEREAS, North Carolina General Statutes § 160A-272 authorizes the County to enter into leases of up to 25 years upon resolution of the Board of Commissioners adopted at a regular meeting after 30 days public notice; WHEREAS, the required notice has been published and the Board of Commissioners is convened in a regular meeting. THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: The Board of Commissioners hereby approves a lease of the County property described above for a period not to exceed 25 years and directs the County Manager to execute any instruments necessary to effectuate the lease.
