June 16, 2014 (Regular Meeting) Page 2080 <br />any other available funds, to finance the acquisition, construction, <br />installation and equipping of a new public elementary school to replace the <br />existing Royal Oaks Elementary School, including acquisition of necessary <br />land and rights -of -way. <br />2. The bonds shall be in an aggregate principal amount not to exceed <br />$11,000,000. <br />3. The bonds shall be general obligations of Cabarrus County for the <br />payment of principal of and interest on which its full faith and credit shall <br />be irrevocably pledged and taxes will be levied in an amount sufficient to <br />pay the principal of and interest on the bonds. <br />4. A sworn statement of debt shall be filed with the Clerk to the <br />Board of Commissioners pursuant to N.C.G.S. § 159 -55 and be open to public <br />inspection. <br />5. This bond order shall take effect when approved by the voters of <br />Cabarrus County. <br />Commissioner Oesterreich then moved that the foregoing bond order be <br />"introduced," such motion was seconded by Commissioner Measmer, and a vote <br />thereon was as follows: <br />Ayes: Vice Chairman Burrage and Commissioners Measmer and Oesterreich <br />Nays: Chairman Poole and Commissioner Morris <br />Not Voting: [None.] <br />read: <br />The Chairman introduced the following resolution, and its title was <br />Resolution No. 2014 -14 <br />RESOLUTION CALLING FOR PUBLIC HEARING ON <br />$11,000,000 GENERAL OBLIGATION SCHOOL BONDS; PROVIDING <br />FOR NOTICE OF SUCH HEARING; AND PUBLICATION OF BOND ORDER AS <br />INTRODUCED <br />WHEREAS, there has been introduced by the Board of Commissioners of <br />Cabarrus County (the "Board ") a bond order entitled "ORDER AUTHORIZING <br />$11,000,000 OF GENERAL OBLIGATION SCHOOL BONDS "; and <br />WHEREAS, N.C.G.S. §159 -54 provides there shall be a public hearing on <br />the bond order and N.C.G.S. §159 -56 provides for publication of the bond <br />order as introduced; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners for the <br />County of Cabarrus, North Carolina: <br />1. A public hearing on the bond order shall be held at 6:30 p.m., <br />(or as soon thereafter as the hearing can be held), in the Commissioners' <br />Meeting Room in the Cabarrus County Governmental Center in Concord, North <br />Carolina on July 21, 2014. <br />2. The Clerk to the Board shall cause the bond order, with a <br />statement appended in the form described by N.C.G.S. §159 -56, to be published <br />once in The Independent Tribune not later than the sixth (6` day before July <br />21, 2014. <br />3. Either of the County Manager or the Finance Officer is hereby <br />designated to file the sworn statement of debt and the statement of estimated <br />interest with respect to the school bonds, each being required by N.C.G.S. <br />§159 -55. <br />4. This resolution shall take effect immediately. <br />Commissioner Oesterreich moved the passage of the foregoing resolution <br />and Commissioner Measmer seconded the motion, and the resolution was passed <br />by the following vote: <br />Ayes: Chairman Poole; Vice Chairman Burrage and Commissioners Measmer, <br />Morris and Oesterreich <br />Nays: [None.] <br />
