September 15, 2014 (Regular Meeting) Page 2164 <br />/s/ Megan Smit <br />Clerk to the Board <br />F -8) Tax Administration - Refund and Release Report - August 2014 <br />Release report contains taxpayers' names, bill numbers, valuations, tax <br />amounts, along with the justifications for releasing the valuation /tax <br />amounts for outstanding levies in accordance with N.C.G.S. 105 -381. Refund <br />report is a summary sheet which lists data from each refund request form, <br />along with the justification for the refunds to the taxpayers in accordance <br />with N.C.G.S. 105 -381. <br />Note: ]due to the transition of motor vehicles onto the new North <br />Carolina Vehicle Tax System (NCVTS), motor vehicle - related refunds and <br />releases will begin to be displayed on the new report generated by NCVTS. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the August 2014 Refund - Release <br />report, along with the NCVTS Refund report, as submitted and granted <br />authority to the Tax Collector to process the refunds and releases. The <br />report is hereby incorporated into the minutes by reference and is on file <br />with the Clerk to the Board. <br />(F -9) Tax Administration - Write -Off of 2004 Real and Personal Outs <br />Taxes <br />The Tax Collector uses diligence in trying to collect all outstanding <br />taxes. However, the 10 -year statute of limitations prevents the Tax <br />Collector from using remedies to collect taxes that are more than 10 years <br />past due. <br />NCCS 105- 378(a) "Use of Remedies Barred" states, that no county or <br />municipality may maintain an action or procedure to enforce any remedy <br />provided by law for the collection of taxes or enforcement of any tax liens <br />unless the action or procedure is instituted within 10 years from the date <br />the taxes became due. <br />Run Date: 9/3/2014 2:41 PM <br />2004 Write Off <br />Cabarrus County <br />Grand Totals <br />Year Assessed Principal Discount Interest Balance Due Real value Personal value Total <br />2004 B0, 3 94 .32 0.00 65,290.39 145,684.71 10,102,390.00 22,632,372.00 32,734,762.00 <br />Totals 80,394.32 0.00 65,290.39 145,684.71 10,102,390.00 22,632,372.00 32,734,762.00 <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the write -off of all outstanding <br />2004 real and personal property taxes remaining as of September 1, 2014 for <br />Cabarrus County and all jurisdictions for which the County collects. <br />G) NEW BUSINESS <br />(G -1) Active Living and Parks - Department Ordinance Related to NCGS 14- <br />415.23 - Public Hearing 6:30 P.M. <br />Vice Chairman Burrage announced Sheriff Brad Riley requested the <br />fairgrounds be exempted from concealed carry for a week during the week of <br />the Fair, Vice Chairman Burrage requested citizen input on the request. <br />Chairman Poole opened the public hearing at 6:59 p.m. The Public <br />Hearing Notice was posted on the County's website (www.cabarrus county. us) on <br />September 3, 2014 in accordance with Article 2, Administration, Section 2.1 <br />(Use of Electronic Means to Provide Public Notices) of the Cabarrus County <br />Code of Ordinances. <br />Representative Larry Pittman, resident of 250 Roberta Road SW in <br />Concord, expressed support for the Second Amendment and exercising those <br />rights with as broad a latitude as current state law allows. <br />William Morris, III, resident of 1440 Duckhorn Street in Concord, spoke <br />in support of the Second Amendment and concealed carry in an open and broad <br />manner. <br />Noel Moreland, resident of 9775 Mount Olive Road in Mount Pleasant, <br />spoke in support of concealed carry in parks and recreation areas. She noted <br />statistics of registered sex offenders within five miles of each of the <br />County parks. She stated allowing concealed carry in county parks will allow <br />her to visit and enjoy the parks. <br />
