October 20, 2014 (Regular Meeting) <br />Page 2176 <br />The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, October 20, 2014, <br />at 6:30 p.m. <br />Present - Chairman: <br />Vice Chairman <br />Commissioners <br />Elizabeth F. Poole <br />Larry M. Burrage <br />Christopher A. Measmer <br />Stephen M. Morris <br />Jason A. Oesterreich <br />Also present were Mike Downs, County Manager; Richard M. Koch, County <br />Attorney; Pam Dubois, Deputy County Manager; and Megan Smit, Clerk to the <br />Board. <br />Chairman Poole called the meeting to order at 6:34 p.m. <br />The Air Force JROTC from Central Cabarrus High School conducted the <br />Flag Ceremony. Students participating were: Cadet Second Lieutenant Jared <br />Davis, Cadet Chief Master Sergeant Martin Ramirez Perez, Cadet Technical <br />Sergeant Cortez Steele, Cadet Second Lieutenant Nohemi Herrera, Cadet Staff <br />Sergeant Lyrick Sabillon, and Cadet Master Sergeant Cesia Castillo Morales. <br />Senior Pastor Kirk Tutterow from Trinity United Methodist Church in <br />Kannapolis delivered the invocation. <br />APPROVAL OR CORRECTION OF MINUTES <br />UPON MOTION of Commissioner Oesterreich, seconded by Vice Chairman <br />Burrage and unanimously carried, the Board approved the minutes of September <br />15, 2014 (Regular Meeting) and October 6, 2014 (Work Session) as written. <br />(B) APPROVAL OF THE AGENDA <br />Chairman Poole reviewed the following changes to the Agenda. She also <br />requested the closed session be moved to follow directly after the Approval <br />of the Agenda. <br />Addition <br />Closed Session <br />L -1 Closed Session - Pending Litigation <br />Moved to November <br />Consent <br />F -1 Finance - Update of the Construction and Renovation Fund Budget, Project <br />Ordinance and Related Budget Amendment <br />Removed <br />New Business <br />G -3 County Attorney - Hotel Occupancy Tax Settlement with online Travel <br />Companies <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the Agenda as amended. <br />(L) CLOSED SESSION <br />(L -1) Closed Session - Pending Litigation <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board moved to go into closed session to consult <br />with the County Attorney concerning threatened or pending litigation as <br />authorized by NCGS 143- 318.11(a)(3). Mike Downs, County Manager, Pam Dubois, <br />Deputy County Manager and Richard Koch, County Attorney, were invited into <br />the closed session. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board moved to come out of closed session. <br />RETURN TO OPEN SESSION <br />C) RECOGNITIONS AND PRESENTATIONS <br />C -1) BOC - Veterans Proclamation <br />Chairman Poole read the proclamation aloud. <br />
