April 15, 2013 (Regular Meeting) Page 1511 <br />1994, 1997, 1999, and 2006 the Cabarrus County Board of Commissioners <br />requested that the North Carolina Geodetic Survey (NCGS) aid us in <br />establishing our boundaries with surrounding counties by a resolution in <br />accordance with GS 153A -18; Greg Belk, Special Boundary Commissioner for <br />Cabarrus County reports that the NCGS has completed its work on the <br />Cabarrus /Stanly County Line and is ready to begin surveying and setting <br />monuments; all taxpayers impacted by the survey have been notified by letter <br />and a public informational meeting was held at the Mt. Pleasant Library on <br />March 7, 2013; and the resolution requests the Cabarrus /Stanly line to follow <br />the center of the river bed of Rocky River from the intersection of the <br />county line with Rocky River southwest to the intersection of the Union <br />County line. <br />Chairman Poole opened the public hearing at 7:41 p.m. The Public <br />Hearing Notice was published on April 5, 2013 in The Independent Tribune. <br />The Public Hearing Notice was also posted on the County's website <br />( www.cabarruscounty.us ) on April 5, 2013 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />Poole closed the public hearing. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage <br />and unanimously carried, the Board approved the NCGS to begin surveying and <br />placing monuments along the Cabarrus /Stanly County line. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage <br />and unanimously carried, the Board approved a resolution to ask the NC <br />Legislature to alter the Cabarrus /Stanly County line to follow the bed of <br />Rocky River as described in the resolution. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage <br />and unanimously carried, the Board approved the Surveying Proposal Agreement <br />with Stewart Inc. subject to revision and /or review by the County Attorney. <br />Resolution No. 2013 -06 <br />RESOLUTION REQUESTING THE RE- SURVEY AND LEGISLATIVE RECOGNITION OF THE JOINT <br />BOUNDARY BETWEEN CABARRUS AND STANLY COUNTIES <br />WHEREAS, the boundary line between Cabarrus and Stanly Counties was <br />first determined as early as 1762 and over the ensuing years the location of <br />that line has become uncertain; and <br />WHEREAS, that boundary has not been verified by field survey since at <br />least 1841 when Stanly County was formed: and <br />WHEREAS, the two counties' Land Records divisions maintain property <br />records, but do not display a single agreed upon boundary line in those tax <br />map records; and <br />WHEREAS, both counties have requested assistance from the North <br />Carolina Geodetic Survey to help resolve the differences in the mapped <br />boundary and have assisted the Geodetic Survey by supplying deed research for <br />all properties located on the joint boundary; and <br />WHEREAS, both counties have notified affected property owners, held <br />public meetings, met with affected property owners individually and held the <br />required Public Hearings at regularly scheduled Board of Commissioner <br />meetings per North Carolina General Statute 153A -18: <br />NOW, THEREFORE, BE IT RESOLVED by the Cabarrus County Board of <br />Commissioners that said Board requests the final re- survey of the agreed upon <br />boundary line be completed and that the North Carolina General Assembly <br />recognize by local legislation that County line with the following <br />provisions: <br />1. On and after January 1, 2014, all papers, documents, and instruments <br />required or permitted to be filed or recorded that involve residents <br />and property located in areas affected by the re- survey of the <br />boundary line, which previously may have been recorded in the <br />adjoining counties, shall be recorded in the correct County based on <br />the agreed upon common border. <br />2. Effective January 1, 2015 all real property located in areas <br />affected by the re- survey of the common boundary line shall be <br />
