The <br />Board of Commissioners adopted resolution number 2012 -14 on September 17, <br />2012, to begin the process of abandoning a portion of Bostian Fisher Road. <br />On December 10, 2012, the North Carolina Department of Transportation (NCDOT) <br />agreed to the abandonment of a portion of Bostian Fisher Road. The next step <br />is for the Board of Commissioners to hold a public hearing and adopt the <br />resolution to officially abandon a portion of the right -of -way of Bostian <br />Fisher Road. <br />Chairman Poole opened the public hearing at 6:52 p.m. The Public <br />Hearing Notice was published on the County's website ( www. cabarrus county. us ) <br />on April 30, 2013 in accordance with Article 2, Administration, Section 2.1 <br />(Use of Electronic Means to Provide Public Notices) of the Cabarrus County <br />Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />Poole closed the public hearing. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage <br />and unanimously carried, the Board adopted the following resolution: <br />RESOLUTION <br />ABANDONMENT AND CLOSURE <br />OF A PORTION OF THE RIGHT OF WAY <br />FOR BOSTIAN FISHER ROAD <br />(STATE ROAD NUMBER 2438) <br />Resolution No. 2013 -09 <br />WHEREAS, North Carolina State Road 2438 in Cabarrus County is known as <br />BOSTIAN FISHER Road, being a paved road approximately .95 miles in length, <br />with the last .10 miles bound on both sides by property owned by ROBERT <br />SEPHEN HOLLIFIELD and being the portion requested to be abandoned by North <br />Carolina Department of Transportation (NCDOT); and <br />WHEREAS, the Board of County Commissioners of the County of Cabarrus <br />passed a resolution on September 17th, 2012 that the above described portion <br />of the road, the location of which has been indicated on the attached map, be <br />abandoned from the Secondary Road System; and <br />WHEREAS, the North Carolina Department of Transportation (NCDOT) <br />authorized the abandonment of maintenance of .10 miles of BOSTIAN FISHER ROAD <br />(SR 2438) during the December 10th, 2012 session; and <br />WHEREAS, the Cabarrus County Board of County Commissioners, at their <br />regular meeting on May 20th, 2013 at 6:30 PM, held a public hearing on their <br />intention to close .10 miles public right of way for BOSTIAN FISHER ROAD (SR <br />2438); and <br />WHEREAS, having received public input on the proposed closing at the <br />meeting, the Cabarrus County Board of Commissioners is of the opinion that <br />the portion of the road to be abandoned should be abandoned. <br />NOW THEREFORE, BE IT RESOLVED that .10 miles of public right of way for <br />BOSTIAN FISHER ROAD (SR 2438) be closed effective this 20th day of May, 2013. , <br />Adopted this 20th day of May, 2013. <br />/s/ Elizabeth F.
