These funds are needed to cover the remainder of the fiscal year. The primary causes of the increased legal fees are tax appeals, APFO lawsuits and interim legal work for DSS. UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White and unanimously carried, the Board adopted the following budget amendment: Date:4/26/2013 Amount:$135,000 Dept. Head: Ann M Wilson Department:Finance ❑ Internal Transfer Within Department Q Transfer Between Departments /Funds ❑ Supplemental Request Purpose: To provide funding for estimated legal expenses through June 30, 2013 from the Contingencv funds Account Number Account Name Approved Budget I Inc Amount I Dec Amount IRevised Budget 0019 - 1110 -9609 Legal Fees $500,000.001 $135,000.00 1 1 $635,000.00 0019 - 1910 -9660 Contingency 1 $214,492.001 1 $135,000.001 $79,492.00 (F -10) General Services - Cabarrus County Construction and Demolition Landfill - Proposed Public /Private Compost Operation Staff presented information at the work session on the proposed public /private compost operation as well as a Memorandum of Understanding (MOU) between Cabarrus County and Agromatters, LLC, as it relates to the creation of a public /private compost operation at the Cabarrus County Construction and Demolition Landfill. UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White and unanimously carried, the Board approved a Memorandum of Understanding (MOU) between Cabarrus County and Argomatters, LLC, as it relates specifically to the Irish Potato Road C &D Landfill, subject to review and /or revision by the County Attorney. (F -11) Planning and Development - Soil and Water Conservation District - Approval of Amendments to North Carolina Clean Water Management Trust Fund Contract Amendment No. 4 and Amendment No. 5 to the North Carolina Clean Water Management Trust Fund Contract have been drafted to incorporate adjustments necessary to close out the design and construction phases and continue implementing the educational and water quality monitoring phases. No new county funding is associated with these amendments. UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White and unanimously carried, the Board approved the amended contract. (F -12) Planning and Development - Soil and Water Conservation District - Proposed Terms for a Stream Restoration Project on Back Creek The Cabarrus Soil and Water Conservation District ( CSWCD) Board and Mogensen Mitigation, Inc. have an agreement whereby CSWCD will identify potential sites for stream restoration and wetland mitigation projects, provide technical assistance and hold conservation easements associated with completed projects. CSWCD has identified a potential project on Back Creek in Harrisburg that includes the stream buffer on the campuses of Hickory Ridge Middle School and Hickory Ridge High School owned by Cabarrus County and the Cabarrus County Board of Education, respectively. CSWCD will submit a proposed project budget to the Board of Commissioners for approval if the project further materializes. UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White and unanimously carried, the Board approved the proposed terms for a stream restoration project on Back Creek between Cabarrus County and Mogensen Mitigation, Inc.
