These funds <br />are needed to cover the remainder of the fiscal year. The primary causes of <br />the increased legal fees are tax appeals, APFO lawsuits and interim legal <br />work for DSS. <br />UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White <br />and unanimously carried, the Board adopted the following budget amendment: <br />Date:4/26/2013 Amount:$135,000 <br />Dept. Head: Ann M Wilson Department:Finance <br />❑ Internal Transfer Within Department Q Transfer Between Departments /Funds ❑ Supplemental Request <br />Purpose: To provide funding for estimated legal expenses through June 30, 2013 from the <br />Contingencv funds <br />Account Number <br />Account Name <br />Approved Budget <br />I Inc Amount <br />I Dec Amount <br />IRevised Budget <br />0019 - 1110 -9609 <br />Legal Fees <br />$500,000.001 <br />$135,000.00 <br />1 <br />1 $635,000.00 <br />0019 - 1910 -9660 <br />Contingency <br />1 $214,492.001 <br />1 $135,000.001 <br />$79,492.00 <br />(F -10) General Services - Cabarrus County Construction and Demolition <br />Landfill - Proposed Public /Private Compost Operation <br />Staff presented information at the work session on the proposed <br />public /private compost operation as well as a Memorandum of Understanding <br />(MOU) between Cabarrus County and Agromatters, LLC, as it relates to the <br />creation of a public /private compost operation at the Cabarrus County <br />Construction and Demolition Landfill. <br />UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White <br />and unanimously carried, the Board approved a Memorandum of Understanding <br />(MOU) between Cabarrus County and Argomatters, LLC, as it relates <br />specifically to the Irish Potato Road C &D Landfill, subject to review and /or <br />revision by the County Attorney. <br />(F -11) Planning and Development - Soil and Water Conservation District - <br />Approval of Amendments to North Carolina Clean Water Management Trust Fund <br />Contract <br />Amendment No. 4 and Amendment No. 5 to the North Carolina Clean Water <br />Management Trust Fund Contract have been drafted to incorporate adjustments <br />necessary to close out the design and construction phases and continue <br />implementing the educational and water quality monitoring phases. No new <br />county funding is associated with these amendments. <br />UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White <br />and unanimously carried, the Board approved the amended contract. <br />(F -12) Planning and Development - Soil and Water Conservation District - <br />Proposed Terms for a Stream Restoration Project on Back Creek <br />The Cabarrus Soil and Water Conservation District ( CSWCD) Board and <br />Mogensen Mitigation, Inc. have an agreement whereby CSWCD will identify <br />potential sites for stream restoration and wetland mitigation projects, <br />provide technical assistance and hold conservation easements associated with <br />completed projects. CSWCD has identified a potential project on Back Creek <br />in Harrisburg that includes the stream buffer on the campuses of Hickory <br />Ridge Middle School and Hickory Ridge High School owned by Cabarrus County <br />and the Cabarrus County Board of Education, respectively. CSWCD will submit <br />a proposed project budget to the Board of Commissioners for approval if the <br />project further materializes. <br />UPON MOTION of Commissioner Burrage, seconded by Vice Chairman White <br />and unanimously carried, the Board approved the proposed terms for a stream <br />restoration project on Back Creek between Cabarrus County and Mogensen <br />Mitigation, Inc. <br />(F -13) Tax Administration - Refund and Release Report - April 2013 <br />
