Commissioner Burrage seconded <br />the motion. The MOTION carried, with Vice Chairman Measmer and Commissioners <br />Burrage and Oesterreich voting for and Chairman Poole and Commissioner Morris <br />voting against. <br />(H -2) Planning and Development - 2012 -2013 HOME CAPER Annual Report - Public <br />Hearing 6:30 P.M. <br />Kelly Sifford, Planning and Development Director, presented the <br />following information relating to a public hearing for the HOME Program — a <br />federally funded, income -based housing rehabilitation program for homeowners: <br />Cabarrus County participates in the Cabarrus /Iredell /Rowan HOME Consortium <br />for housing rehabilitation each year; last year there were issues obtaining <br />qualified applicants and $858.00 were expended on advertising, public <br />hearing, etc. She also stated there are projects underway at this time. <br />Chairman Poole opened the public hearing at 7:32 p.m. The Public <br />Hearing Notice was published on August 7 and 11, 2013 in The Independent <br />Tribune. The Public Hearing Notice was also posted on the County's website <br />( www.cabarrus county. us ) on August 7, 2013 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />Poole closed the public hearing. No action was required. <br />(H -3) County Manager - Revision to Chapter 78, Article III Code of <br />Ordinances - Public Hearing 6:30 P.M. <br />Jonathan Marshall, Deputy County Manager, presented the following <br />information relating to a revision to Chapter 78, Article III of the Code of <br />Ordinances: <br />The Water and Sewer Authority of Cabarrus County (WSACC) has made <br />changes to their Sewer Use Ordinance (SUO) to include new federal <br />and state regulations. This ordinance allows WSACC to implement <br />their pretreatment program for wastewater. There is an agreement <br />between WSACC and Cabarrus County that requires the County to <br />adopt an SUO that is the same as WSACC. That ordinance is <br />included in Chapter 78, Article III of the Code of Ordinances. <br />Chairman Poole opened the public hearing at 7:33 p.m. The Public <br />Hearing Notice was posted on the County's website ( www. cab arrus county. us ) on <br />August 7, 2013 in accordance with Article 2, Administration, Section 2.1 (Use <br />of Electronic Means to Provide Public Notices) of the Cabarrus County Code of <br />Ordinances. <br />There was no one present to address the Board; therefore Chairman Poole <br />closed the public hearing. <br />Mr. Marshall responded to questions from the Board. <br />Chairman Poole reviewed the request for clarification.. <br />UPON MOTION of Commissioner Burrage, seconded by Vice Chairman Measmer <br />and unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2013 -19 <br />Ordinance Amending Chapter 78, Utilities <br />of the Code of Ordinances in Cabarrus County, North Carolina <br />Be it ordained by the Cabarrus County Board of Commissioners that <br />Chapter 78, Article III, Sewer Use of the Code of Ordinances in Cabarrus <br />County, North Carolina is hereby amended to read as follows: <br />Article III. - Sewer Use <br />Revised text file of Chapter 78, Article III attached. <br />Adopted this the 19 day of August, 2013. <br />Effective: September 1, 2013. <br />/s/ Elizabeth F.
