November 4, 2013 (Work Session) <br />Page 1804 <br />This item was tabled until the December meeting in order for more <br />information to be gathered. <br />Library - Request to Approve Midland Library Concept <br />Richard Flowe, Town of Midland Planning, Zoning and Subdivision <br />Administrator, presented the following information regarding the Town of <br />Midland Library concept: <br />The Midland Council passed the following on October 8, 2013: <br />The Town of Midland is in the process of building a 16,000+ sq. <br />ft. town hall and library building and will dedicate <br />approximately 3,100 sq. ft. on the 2nd floor of the building to <br />the Midland branch of the Cabarrus County Library. The Town of <br />Midland requests the Cabarrus County Commission to approve the <br />appropriate staff, utility, power and other necessary monthly <br />payments for the library that will be further outlined in a <br />contract as worked out by Cabarrus County and Midland staff. <br />A discussion followed. During discussion Mr. Flowe, Dana Eure, Library <br />Director and Kyle Bilafer, General Services Director, responded to questions <br />from the Board. <br />Chairman Poole requested the presence of a Midland Town Council <br />representative at the regular meeting to address questions. <br />Active Living and Parks Department - Department Ordinance Related to NCGS 14- <br />415.23 <br />Londa Strong, Active Living and Parks Director, presented the following <br />information regarding requested direction for the Parks Ordinance in relation <br />to recent changes in the North Carolina General Statutes: <br />The North Carolina General Statutes (NCGS) have been amended <br />regarding concealed carry permit holders, allowing those <br />possessing a concealed carry permit to carry guns in local parks. <br />The statute permits local jurisdictions to identify specific <br />areas in which concealed carry permit holders are not allowed to <br />carry, dependent on the governing body adopting an ordinance <br />prohibiting concealed carry in specific areas and installing <br />signs. <br />The areas where concealed carry can be restricted are: pools - <br />including the attached amenities; recreation facilities - <br />including areas with gymnasiums; and athletic facilities - <br />including bleachers, restrooms, concession areas and parking <br />areas in close proximity. <br />Concord, Kannapolis and Harrisburg have adopted an ordinance <br />prohibiting the concealed carry of firearms in those three <br />defined areas of their parks. Concord has signs posted and the <br />other two municipalities are determining how to proceed. <br />The open carry of firearms can be prohibited in public places. <br />The Active Living and Parks Department Ordinance currently <br />prohibits firearms in parks, although it is not being enforced in <br />a manner consistent with adopted statutes. Since the ordinance is <br />in contradiction to statutes, the Active Living and Parks <br />Ordinance needs to be updated to reflect statute changes for <br />compliance with new general statutes (concealed carry) and /or to <br />regulate existing ones (open carry). <br />A discussion followed. During discussion Ms. Strong and Richard Koch, <br />County Attorney, responded to questions from the Board. Mike Murphy, Parks <br />Superintendent, was also in attendance. <br />Chairman Poole requested a copy of the City of Concord's updated <br />ordinance for review prior to the regular meeting. <br />County Manager - Qualified School Construction Bond (QSCB) Interest Earnings <br />Pam Dubois, Deputy County Manager, provided the following information <br />relating to Qualified School Construction Bond (QSCB) interest earnings: <br />
