July 16, 2012 (Regular Meeting) Page 1156 <br />Marjorie Benbow, JD, MBA, MSPH, and resident of Concord, spoke in <br />support of C- Voltaics' bid for the old Bethel School property. <br />With there being no one else to address the Board, Chairman Poole <br />closed that portion of the meeting. <br />(w) OLD BUSINESS <br />(E -1) BOC - Old Bethel School Property <br />Jonathan Marshall, Deputy County Manager, advised two (2) bids for <br />$10,000.00 were received for the old Bethel School property and explained the <br />upset bid process stating the Board may accept one of the bids or both bids <br />to begin the upset bid process as outlined in the resolution in the agenda <br />packed. He stated each time a new qualifying bid is received, the upset bid <br />process will begin again until a ten (10) day period without a bid, is <br />reached. He also responded to questions from the Board concerning estimates <br />for lead abatement and demolition costs. <br />Dr. A. L. Fleming, bidder for the property, responded to questions from <br />the Board regarding plans for the project and Woodson University's <br />accreditation. <br />In response to questions from the Board, David Pugh, Midland Town <br />Administrator, advised a preliminary review was conducted on both bids at the <br />request of the County Manager. He stated, based on the bids, both bids are <br />acceptable under the current zoning designation (civic). <br />Dr. Ken Russell, C- Voltaics representative, responded to questions from <br />the Board relating to Dr. Curran's vision for the property and possible <br />collaborations with other technology- related industries in Cabarrus County <br />and across the State. <br />After discussion, Commissioner Carruth MOVED to accept the bid from <br />Woodson University for the old Bethel School property and to adopt the <br />resolution outlining the upset bid process. After further discussion, <br />Commissioner Measmer seconded the motion and the MOTION carried unanimously. <br />Resolution No. 2012 -12 <br />Resolution Authorizing Upset Bid Process <br />Old Bethel School Property <br />WHEREAS, Cabarrus County is the owner of parcels of land known as the Old <br />Bethel School Property on Highway 24 -27 (the `Property "), as indicated on the <br />attached Exhibit A, which Property is surplus to its needs; and <br />WHEREAS, N.C. Gen. Stat. § 16OA -269 permits the County to sell real <br />property by upset bid, after receipt of an offer for the property; and <br />WHEREAS, the County has received two (2) offers to purchase the property <br />described above, both in the amount of $10,000.00, submitted by Woodson <br />University and C- Voltaics, Inc.; and <br />WHEREAS, Woodson University and C- Voltaics, Inc. have paid the required <br />five percent (50) deposits on their offers: <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br />1. The County Commissioners authorizes sale of the property described <br />above through the upset bid procedure of North Carolina General <br />Statute § 160A -269. <br />2. The county clerk shall cause a notice of the proposed sale to be <br />published. The notice shall describe the property and the amount of <br />the offer, and shall state the terms under which the offer may be <br />upset. <br />3. Persons wishing to upset the offer that has been received shall submit <br />a sealed bid with their offer to the office of the county manager <br />within 10 days after the notice of sale is published. During the 10 <br />day bidding period, the clerk shall open any bids received, if any, <br />and the highest such bid will become the new offer. If there is more <br />than one bid in the highest amount, the first such bid received will <br />become the new offer. <br />
