A brief discussion ensued. Chairman White expressed support for
abolishing the Adequate Public Facilities Ordinance, but was uncertain as to
the amount of time staff will need to identify potential problems. County
Manager John Day suggested the item be tabled to some point in the future to
research the matter and to address other issues raised by the Board in closed
session.
UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth
and unanimously carried, the Board voted to table the APF VMP Adjustment for
CY 2011 to April 4, 2011.
Commerce - Consent Agreement and School Capacity Information for Meridian
Susie Morris, Planning and Zoning Manager, presented the following
information regarding a consent agreement for the Meridian subdivision:
The Meridian subdivision was approved by the City of Concord
Planning and Zoning Board on October 19, 2004. The project
consists of 16 single- family residential lots on +/- 8.9 acres
located off Roberta Road. The specifics of the agreement are as
follows:
• Developer - Guelaguetza Homes, LLC, 4175 Amarillo Drive,
Concord, NC 28027.
• Payment of $4,034.00 per lot payable prior to platting.
• A Consent Agreement for this project was approved by the Board
of Commissioners on November 15, 2004. The Consent Agreement
was renegotiated on June 18, 2007. The renegotiated Consent
Agreement, however, was never executed by Roberta Road, LLC.
• All 16 lots in the project were final platted with the City of
Concord on November 9, 2007.
• Mr. Zandate, owner of Guelaguetza Homes, LLC, purchased the
Meridian project in August of 2010 and is ready to proceed
with building permitting and construction.
• Mr. Zandate is requesting that the required Voluntary
Mitigation Payment be allowed at building permitting, instead
of in one lump sum prior to permitting, since all of the lots
have already been platted with the City of Concord.
The APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus
County Schools indicates that schools impacted by the Meridian
subdivision are currently functioning at the following
capacities:
