January 3, 2011 (Work Session) <br />Page 271 <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board voted to place "Presentation of Results of <br />the Fall 2010 Citizen Survey" on the January 18, 2011 Agenda as a New <br />Business item. <br />County Attorney - Memorandum of Understanding - Local Government Agents and <br />Employees to Follow Certain Board of Education Policies <br />Richard Koch, County Attorney, advised that the Cabarrus County Board <br />of Education's Attorney submitted a Memorandum of Understanding (MOU) for the <br />Board's consideration that confirms that county employees or its agents will <br />follow certain school policies concerning alcohol, tobacco and registered sex <br />offenders, etc., while on school property for work - related purposes. <br />A lengthy discussion ensued and several Board members expressed <br />opposition to the MOU since many of the items addressed in the Agreement are <br />already covered by State law. Vice Chairman Poole suggested the item be <br />tabled and for the County Attorney and County Manager to discuss the MOU with <br />the Superintendent. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth <br />and unanimously carried, the Board voted to table the "Memorandum of <br />Understanding - Local Government Agents and Employees to Follow Certain Board <br />of Education Policies" until the February 7, 2011 work session. <br />Vice Chairman Poole requested the County Manager contact the Cabarrus <br />County School Superintendent. She stated she or Chairman White would contact <br />the Cabarrus County Board of Education Chair. <br />Emergency Management - Cabarrus County Hazard Mitigation Plan - Public <br />Hearing 6:30 P.M. <br />Bobby Smith, Emergency Management Director, requested a public hearing <br />be held in relation to the adoption of the 5 -year update to the Cabarrus <br />County Hazard Mitigation Plan by resolution. He reported the Plan is a <br />requirement of FEMA (Federal Emergency Management Agency) and N.C. Emergency <br />Management. He further reported an approved Plan is required to receive <br />disaster funding and the County's Plan has received conditional approval from <br />FEMA, pending Board approval. Finally, he reported the surrounding Towns <br />adopted the Plan by resolution, Concord has its own plan and that Kannapolis <br />is part of Rowan County's plan. He also responded to questions from the <br />Board. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Burrage <br />and unanimously carried, the Board voted to place Cabarrus County Hazard <br />Mitigation Plan on the January 18, 2011 Agenda as a New Business item and <br />scheduled a public hearing for 6:30 p.m. <br />Fair - 2010 Cabarrus Countv Fair Reca <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board voted to place the "2010 Cabarrus County <br />Fair Recap" on the January 18, 2011 Agenda as New Business item. <br />Finance - First Time Waiver of Occupancy Tax Penalties, Great Wolf Lodge - <br />$10,200.96 <br />Pam Dubois, Deputy County Manager, presented the following information <br />related to a first time waiver of occupancy tax penalties for Great Wolfe <br />Lodge: <br />On April 19, 2004, the Board of Commissioners amended the waiver <br />of occupancy tax late payments penalties as follows: "the County <br />shall, for good cause shown, review request by the affected <br />taxpayer for the waiver of late payment penalties for Hotel/Motel <br />Occupancy taxes for the first late payment offense. The County <br />Finance Director and Deputy County Manager shall have authority, <br />for good cause shown, to compromise or forgive these late <br />payments penalties up to a maximum amount of $1,000. No request <br />for waivers of subsequent offenses by the same taxpayer will be <br />considered." Great Wolf Lodge's occupancy tax payment was <br />postmarked on December 21, 2010, which is one day late. <br />Therefore, the hotelier has incurred a $10,200.96 penalty. <br />Although this is the hotelier's first offense, the penalty amount <br />
