January 18, 2011 (Regular Meeting) <br />(E) OLD BUSINESS <br />Page 275 <br />(E -1) APPAC - Resolution Pertaining to Future of Animal Shelter in Cabarrus <br />County - Tables from December <br />Commissioner Carruth advised the January 10 Animal Protection and <br />Preservation Advisory Committee (APPAL) meeting was canceled due to inclement <br />weather and rescheduled to January 13 th . He stated the committee met and <br />reviewed the resolution. He recommended the Board review the resolution at <br />its retreat and then to vote on it at the February 21S regular meeting. <br />Further, he reported the Sheriff and Humane Society support the concept of <br />transferring sheltering operations from the Animal Control Division to the <br />Humane Society through a contractual relationship. <br />Commissioner Carruth MOVED to table the APPAC resolution to the Board's <br />Retreat on January 28 and 29 and placed on the February 21, 2011 Agenda. <br />Commissioner Measmer seconded the motion. <br />Commissioner Carruth responded to a variety of questions from the <br />Board. The MOTION unanimously carried. <br />(F) CONSENT AGENDA <br />(F -1) Commerce - Consent Agreement and School Capacity Information for <br />Meridian Subdivision <br />The applicant is Guelaguetza Homes, LLC, 4175 Amarillo Drive, Concord, <br />NC 28027. The request is for 16 single family residential lots on +/- 8.9 <br />acres located off Roberta Road in the City of Concord, North Carolina. The <br />project received preliminary plat approval from the City of Concord Planning <br />and Zoning Board on October 19, 2004. A Consent Agreement is required for <br />the project to proceed. Based on the original date of preliminary plat <br />submittal, the Voluntary Mitigation Payment is generated from the pre- August <br />2007 Ordinance. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the Consent Agreement between <br />Cabarrus County and Guelaguetza Homes, LLC for the Meridian subdivision <br />project, including the payment of $4,034.00 per lot to advance school <br />adequacy with payment due prior to building permitting and authorized the <br />County Manager to execute the Agreement on behalf of Cabarrus County, subject <br />to review or revisions by the County Attorney. <br />(F -2) County Manager - Resolution Authorizing Sale of the Old Bethel School <br />Property <br />The following resolution sets forth the new terms and conditions in <br />accordance with NCGS 160A -268. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth <br />and unanimously carried, the Board adopted the following resolution: <br />RESOLUTION AUTHORIZING AUCTION SALE <br />OF THE OLD BETHEL SCHOOL PROPERTY <br />Resolution No. 2011 -01 <br />WHEREAS, Cabarrus County is the owner of parcels of land known as the Old <br />Bethel School Property on Highway 24 -27 (the "Property "), as indicated on the <br />attached Exhibit A, which Property is surplus to its needs; and <br />WHEREAS, North Carolina General Statutes § 160A -268 permits the County to <br />sell real property by advertisement and sealed bid. <br />THE BOARD OF COMMISSIONERS OF CABARRUS COUNTY RESOLVES THAT: <br />1. The Board of Commissioners hereby authorizes the sale by sealed bid <br />of the Property indicated on Exhibit A. <br />2. The County will accept sealed bids for the Property until 3:00 <br />p.m., Monday, February 28, 2011. Bids shall be delivered to the office of John <br />Day, County Manager, Second Floor, Cabarrus County Governmental Center, 65 <br />Church Street, Concord, North Carolina. <br />3. At 3:00 p.m. on Monday, February 28, 2011, all bids received shall <br />be opened in public and the amount of each bid recorded. The record of bids <br />
