March 21, 2011 (Regular Meeting) Page 356 technical capacity to implement and manage the project, prepare required reports, obtain required training, attend meetings and conferences; and agrees to comply with the federal and state statues, regulations, executive orders, and all administrative requirements related to the applications made to and grants received from the North Carolina Department of Transportation; NOW, THEREFORE, be it resolved that the Chairman of the Board of Commissioners is hereby authorized to submit a grant application for state funding, make the necessary assurances and certifications and be empowered to enter into an agreement with the NCDOT to provide rural public transportation services. (G -3) Board of Elections - Presentation of Board of Elections Construction Cost Bid Summary and Updated Project Ordinance Mike Downs, Deputy County Manager, briefly reviewed the process of selecting a site for the new Board of Elections facility, including procurement of a local architecture firm and a local contractor to serve as Construction Manager (CM) at Risk. Further, he advised that the next step in the process is to approve Amendment No. 1 to the Contract for Construction Manager At Risk for the Construction of the Cabarrus County Board of Elections Renovation Project Between Cabarrus County, Owner and CM Black Construction Company, Inc., Construction Manager At Risk with a Guaranteed Maximum Price (GMP) of $1,178,034.00. He advised that the old Creamery building, located at 369 Church Street, is just over 10,000 square feet, will house the Board of Elections office, provide warehouse space, and include a large community room to be used for a variety of uses. Mr. Downs also responded to several questions from the Board and provided a description of the CM at Risk process. During discussion it was noted that 30 percent of the bids for this project are from Cabarrus County contractors. Commissioner Carruth MOVED to approve the Guaranteed Maximum Price and authorized the County Manager to execute the Amendment No. 1 to the Contract for Construction Manager at Risk for the Construction of the Cabarrus County Board of Elections Renovation Project between Cabarrus County, owner, and CM Black Construction Company, Inc., Construction Manager at Risk, subject to revision by the County Attorney, and to adopt the amended Project Ordinance. Chairman White seconded the motion. Following a short discussion and the identification of the substantial completion date of August 31, 2011, the MOTION unanimously carried. The Project Ordinance and Amendment No. 1 are as follows: BOARD OF ELECTIONS PROJECT ORDINANCE Ordinance No. 2011 -04 BE IT ORDAINED, by the Board of County Commissioners of the County of Cabarrus, North Carolina that, pursuant to Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project ordinance is hereby adopted: Section 1. The project authorized is the design, renovation, and up fit of the newly purchased facility to house the Board of Election on a non -debt issued basis. The project is funded by Capital Project Funds. Section 2. The officers of this unit are hereby directed to proceed with this capital project within the terms contained in the project ordinance. Section 3. The following budgeted amounts are appropriated for the projects: Board of Elections: Building Up fit cost /furnishings $ 839,302 $1, 641, 998 Section 4. The following revenues are anticipated to be available to complete this project: Capital Project Funds $2,481,300
