March 21, 2011 (Regular Meeting) <br />Page 356 <br />technical capacity to implement and manage the project, prepare <br />required reports, obtain required training, attend meetings and <br />conferences; and agrees to comply with the federal and state statues, <br />regulations, executive orders, and all administrative requirements <br />related to the applications made to and grants received from the North <br />Carolina Department of Transportation; <br />NOW, THEREFORE, be it resolved that the Chairman of the Board of <br />Commissioners is hereby authorized to submit a grant application for <br />state funding, make the necessary assurances and certifications and be <br />empowered to enter into an agreement with the NCDOT to provide rural <br />public transportation services. <br />(G -3) Board of Elections - Presentation of Board of Elections Construction <br />Cost Bid Summary and Updated Project Ordinance <br />Mike Downs, Deputy County Manager, briefly reviewed the process of <br />selecting a site for the new Board of Elections facility, including <br />procurement of a local architecture firm and a local contractor to serve as <br />Construction Manager (CM) at Risk. Further, he advised that the next step in <br />the process is to approve Amendment No. 1 to the Contract for Construction <br />Manager At Risk for the Construction of the Cabarrus County Board of <br />Elections Renovation Project Between Cabarrus County, Owner and CM Black <br />Construction Company, Inc., Construction Manager At Risk with a Guaranteed <br />Maximum Price (GMP) of $1,178,034.00. He advised that the old Creamery <br />building, located at 369 Church Street, is just over 10,000 square feet, will <br />house the Board of Elections office, provide warehouse space, and include a <br />large community room to be used for a variety of uses. Mr. Downs also <br />responded to several questions from the Board and provided a description of <br />the CM at Risk process. During discussion it was noted that 30 percent of <br />the bids for this project are from Cabarrus County contractors. <br />Commissioner Carruth MOVED to approve the Guaranteed Maximum Price and <br />authorized the County Manager to execute the Amendment No. 1 to the Contract <br />for Construction Manager at Risk for the Construction of the Cabarrus County <br />Board of Elections Renovation Project between Cabarrus County, owner, and CM <br />Black Construction Company, Inc., Construction Manager at Risk, subject to <br />revision by the County Attorney, and to adopt the amended Project Ordinance. <br />Chairman White seconded the motion. Following a short discussion and the <br />identification of the substantial completion date of August 31, 2011, the <br />MOTION unanimously carried. <br />The Project Ordinance and Amendment No. 1 are as follows: <br />BOARD OF ELECTIONS PROJECT ORDINANCE <br />Ordinance No. 2011 -04 <br />BE IT ORDAINED, by the Board of County Commissioners of the <br />County of Cabarrus, North Carolina that, pursuant to Section 13.2 <br />of Chapter 159 of the General Statutes of North Carolina, the <br />following capital project ordinance is hereby adopted: <br />Section 1. The project authorized is the design, <br />renovation, and up fit of the newly purchased facility to house <br />the Board of Election on a non -debt issued basis. The project is <br />funded by Capital Project Funds. <br />Section 2. The officers of this unit are hereby directed <br />to proceed with this capital project within the terms contained <br />in the project ordinance. <br />Section 3. The following budgeted amounts are appropriated <br />for the projects: <br />Board of Elections: <br />Building <br />Up fit cost /furnishings <br />$ 839,302 <br />$1, 641, 998 <br />Section 4. The following revenues are anticipated to be <br />available to complete this project: <br />Capital Project Funds $2,481,300 <br />
