It would also add "Ethanol Fuel Production Small and <br />Medium Plants" as defined in the Code of Federal Regulations, to <br />the General Industrial District as a "Permitted Based on Standards" <br />(PBS) use. Ms. Morris also responded to questions from the Board. <br />Chairman White opened the public hearing at 6:54 p.m. The Public <br />Hearing Notice was published on April 6 and 13, 2011 in THE INDEPENDENT <br />TRIBUNE. The Public Hearing Notice was also posted on the County's website <br />( www.cabarruscounty.us ) on April 6, 2011 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />Danny Yearty, resident of 5959 Rocky River Road, expressed support for <br />the text amendment, noting it was his enquiries that led to the development <br />of the text amendment. He also expressed concern regarding the required <br />amount of setbacks from dwellings and property lines. Mr. Yearty also <br />responded to questions from the Board. <br />Price Crutchfield, resident of 592 Love Street in Concord, stated he is <br />undecided on the matter but questioned whether the location of ethanol <br />production facilities should be noted in a databank for Homeland Security <br />purposes. <br />With there being no one else to address the Board, Chairman White <br />closed the public hearing. <br />Following comments from the Board, Commissioner Carruth MOVED to <br />approve Zoning Ordinance Text Amendment 2011- 00001. Commissioner Measmer <br />seconded the motion and the MOTION unanimously carried. <br />The Ordinance is as follows: <br />ZONING ORDINANCE <br />TEXT2011 -00001 <br />Ordinance No. 2011 -05 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />ADD the following text to Chapter 7, Performance Based Standards (PBS) <br />47. Ethanol Fuel Production (Residential District, Private Use Only) <br />Zones Permitted Based on Standards - Agriculture /Open Space, Countryside <br />Residential, Low Density Residential, Medium Density Residential <br />STANDARDS: <br />A. Site Plan: An approved site plan is required showing the location of <br />all buildings, setbacks and required distances from other structures as <br />described below. <br />
