(G -2) Commerce - APPL2010- 00003, Appeal of Rezoning Case RZON2010 -00007 and
Public Hearing - 6:30 P.M. (Tabled from March to April 18)
Richard Koch, County Attorney, presented the following information
related to APPL2010- 00003, Appeal of Rezoning Case RZON2010 -00007 for
property located at 12475 Pioneer Mill Road, PIN No. 5524 -47 -5954:
Steve Fisher entered into a real estate contract with Patricia Barr, to
buy her property on the condition he could have it rezoned and a rezoning
application was submitted last year by them. Although there was some
opposition, the rezoning was approved by the Cabarrus Planning and Zoning
Commission, but then appealed to the Board of Commissioners. In the
meantime, Ms. Barr, the mother of Mr. Barnes and Ms. Covington and three of
their siblings passed away and the property now belongs to the siblings, one
of whom is Patrice Moore. Due to the circumstances, Mr. Fisher decided to
withdraw his part of the rezoning application and is no longer under contract
to buy the property. The issue then becomes whether the actual property
owners at this point, also want to withdraw their part of the rezoning
application. Mr. Barnes' and Ms. Covington's brother and sisters are from
Robins, North Carolina, except for Ms. Moore, and after discussion with their
other siblings, have decided to withdraw the rezoning application. That way,
they will have the opportunity to apply for a rezoning in the future, if
necessary, when they ultimately find a buyer.
Mr. Koch advised that he personally spoke with Ms. Moore earlier today
and she wants to withdraw the application. Finally, after consultation with
the brother and sisters, Mr. Koch reported Mr. Barnes and Ms. Covington want
to withdraw their rezoning application.
For the record and on behalf of their other siblings, individually and
collectively, Robin Covington and Eric Barnes stated their desire to withdraw
the application.
No action was required of the Board.
