April 18, 2011 (Regular Meeting) Page 402 <br />ADD Ethanol Fuel Production to Permitted Use Table in Chapter 3 <br />RENUMBER table in Section 3 -8. <br />ADD the following text to Chapter 2, Rules of Construction and Definitions: <br />Ethanol Fuel Production /Alcohol Fuel Plant <br />A special type of distilled spirits plant for producing, storing, using or <br />distributing distilled spirits to be used exclusively for fuel use. See Code of <br />Federal Regulations, Title 27, Part 19. <br />1. Ethanol Fuel Production, Residential District, Personal Use Only, <br />see Chapter 7 for standards. <br />2. Small Plant -An Alcohol fuel plant that produces (including <br />receives) not more than 10,000 proof gallons of spirits per <br />calendar year. <br />3. Medium Plant -An Alcohol fuel plant that produces (including <br />receives) more than 10,000 but not more than 500,000 proof gallons <br />of spirits per calendar year. <br />F'ncl Al nnhnl <br />Distilled spirits that have been made unfit for beverage use at an alcohol fuel <br />plant. (Tabled from March to April 18) <br />Richard Koch, County Attorney, presented the following information <br />related to APPL2010- 00003, Appeal of Rezoning Case RZON2010 -00007 for <br />property located at 12475 Pioneer Mill Road, PIN No. 5524 -47 -5954: <br />Steve Fisher entered into a real estate contract with Patricia Barr, to <br />buy her property on the condition he could have it rezoned and a rezoning <br />application was submitted last year by them. Although there was some <br />opposition, the rezoning was approved by the Cabarrus Planning and Zoning <br />Commission, but then appealed to the Board of Commissioners. In the <br />meantime, Ms. Barr, the mother of Mr. Barnes and Ms. Covington and three of <br />their siblings passed away and the property now belongs to the siblings, one <br />of whom is Patrice Moore. Due to the circumstances, Mr. Fisher decided to <br />withdraw his part of the rezoning application and is no longer under contract <br />to buy the property. The issue then becomes whether the actual property <br />owners at this point, also want to withdraw their part of the rezoning <br />application. Mr. Barnes' and Ms. Covington's brother and sisters are from <br />Robins, North Carolina, except for Ms. Moore, and after discussion with their <br />other siblings, have decided to withdraw the rezoning application. That way, <br />they will have the opportunity to apply for a rezoning in the future, if <br />necessary, when they ultimately find a buyer. <br />Mr. Koch advised that he personally spoke with Ms. Moore earlier today <br />and she wants to withdraw the application. Finally, after consultation with <br />the brother and sisters, Mr. Koch reported Mr. Barnes and Ms. Covington want <br />to withdraw their rezoning application. <br />For the record and on behalf of their other siblings, individually and <br />collectively, Robin Covington and Eric Barnes stated their desire to withdraw <br />the application. <br />No action was required of the Board. <br />(G -3) FPC - Food Policy Council: 2011 Retreat Report, Mission Statement, <br />Goals and Logo <br />Aaron Newton, Local Food System Program Coordinator, introduced Food <br />Policy Members Chris Jones, Buckhead Beef Specialist with Sysco Charlotte, <br />LLC, and Lisa Wacheldorf, Market Manager of Piedmont Farmer's Market.
