June 6, 2011 (Work Session) <br />Page 458 <br />• Parks Dept. - Proclamation - Designation of July as Park and Recreation <br />Month <br />• Tax Administration - Refund and Release Report - May 2011 <br />• Tourism Authority - Presentation and Approval of the FY 2011 Tourism <br />Authority Budget - $3,718,762.00 <br />Parks Department - Adoption of an Ordinance Amending Chapter 50, Parks, of <br />the Cabarrus County Code of Ordinances <br />Londa Strong, Parks Director, and Johanna Ray, Cabarrus County Wellness <br />Coordinator, presented information relating to the prohibition of all tobacco <br />products /use in all County owned and operated parks, as approved by the Parks <br />Commission in April. The development of the ordinance was a collaborative <br />effort between the County, local Municipalities and the Cabarrus Health <br />Alliance (CHA). <br />Erin Shoe, CHA Program Coordinator, advised she coordinates the Teen <br />Tobacco Use Prevention and Cessation Program. She reported tobacco use was <br />identified as a problem among youth in the 2000, 2004 and 2008 Community <br />Needs Assessments. She introduced Healthy Cabarrus Teen Task Force members <br />Jordan Tucker, Femi Ann Balogun and Rachel King who presented a PowerPoint <br />presentation entitled, "Cabarrus County Tobacco -Free Parks Ordinance ". <br />Information addressed in the presentation is as follows: second -hand smoke, <br />parks are family friendly venues, environmental concerns, smoke -free vs. <br />tobacco -free and tobacco -free reality. Task force members also responded to <br />questions from the Board. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Burrage <br />and unanimously carried, the Board voted to place Adoption of an Ordinance <br />Amending Chapter 50, Parks, of the Cabarrus County Code of Ordinances on the <br />June 20, 2011 Agenda as a Consent item. <br />Harrisburg - Request by Harrisburg and Charlotte- Mecklenburg Utility <br />Department (CMU) for Transfer of Ownership of Water / Sewer Lines in Cabarrus <br />County <br />Todd Taylor, Harrisburg Public Works Director, generally presented the <br />following information related to a joint request to transfer ownership of <br />water / sewer lines located in Cabarrus County: <br />The Town of Harrisburg intends to purchase from the Charlotte - <br />Mecklenburg Utility Department (CMU) water and sewer customers <br />and infrastructure previously owned and operated by Utilities <br />Incorporated (UI) in the south - western quadrant of Harrisburg's <br />future service /annexation area. CMU will acquire these systems <br />through a larger purchase in Mecklenburg County related to the <br />City of Charlotte's 2009 annexation. The Town will receive over <br />10 miles of water and sewer mains, an elevated storage tank, 3 <br />groundwater treatment facilities, 2 well sites, 6 sewer pumping <br />stations and 1 wastewater treatment facility. Over 900 County <br />residents will be affected by the purchase including the Cabarrus <br />Woods, Bradford Park, Britley and Steeplechase neighborhoods. <br />These customers will see a reduction in their monthly utility <br />costs of approximately 25 percent. In order for the purchase to <br />occur, the State's Utilities Commission is requiring CMU to take <br />ownership of the entire system (including the portions in <br />Cabarrus County) for a period of time (a maximum of 15 days) <br />before transferring ownership to Harrisburg. The Town of <br />Harrisburg and CMU, in accordance with N.C.G.S. 153A -15, are <br />requesting that the County Commission grant CMU permission to <br />take ownership of the property which will allow the purchase to <br />move forward. <br />Mr. Taylor also reported the contact between the Town and Charlotte has <br />been executed. <br />Barry Shearin, Charlotte - Mecklenburg Chief Engineer and Carolina Water <br />Incorporated Acquisition Project Manager, stated the original intent was to <br />directly transfer property ownership to Harrisburg. However, due to human <br />error and working with the Utility Commission, he said the order was issued <br />as if the Charlotte Mecklenburg Utility was buying the entire system. Due to <br />time constraints, he advised the best way to proceed, under N.C.G.S. 153A -15, <br />is to ask the Cabarrus County Board of Commissioners for permission for <br />Charlotte to purchase the property for a few days before the title is <br />
