Jay White, Sr., Chairman <br />ATTEST: <br />/s/ Kay Honeycutt <br />Clerk to the Board <br />(F -9) Fire Marshal - Contract to Provide Tax District Fire Service (Concord <br />/ Jackson Park) <br />In March, the Board of Commissioners approved the non - renewal of the <br />fire protection contract with the Jackson Park VFD, effective June 30, 2011. <br />The Fire Marshal recommends the County contract with the City of Concord to <br />provide fire protection services to the Jackson Park Rural Fire Protection <br />District as set forth in the agreement. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the contract between Cabarrus <br />County and the City of Concord for fire protection services for the Jackson <br />Park Rural Fire Protection District, subject to review and or revisions by <br />the County Manager or County Attorney. <br />(F -10) Parks Dept. - Adoption of an Ordinance Amending Chapter 50, Parks, of <br />the Cabarrus County Code of Ordinances <br />The Cabarrus County Parks Commission requested research, reviewed and <br />discussed the findings, and unanimously approved to recommend prohibiting the <br />use of all tobacco products in all Cabarrus County owned and operated Parks. <br />The Cabarrus County Wellness Director and Cabarrus County Health Alliance <br />worked with the Parks Department in the development of an ordinance to <br />prohibit the use of all tobacco products in all Cabarrus County parks. The <br />Ordinance is the result of their research. Harrisburg Parks and Recreation <br />is the only Department in the County with an ordinance prohibiting the use of <br />all tobacco products on their park grounds and in their buildings. Other <br />municipalities in the County are exploring the possibilities of some type of <br />tobacco policy at this time. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Measmer <br />and unanimously carried, the Board adopted the following ordinance amending <br />Chapter 50, Parks, of the Cabarrus County Code of Ordinances: <br />Ordinance No. 2011 -28 <br />ORDINANCE AMENDING CHAPTER 50. (PARKS) <br />OF THE CABARRUS COUNTY CODE OF ORDINANCES <br />BE IT ORDAINED by the Cabarrus County Board of Commissioners that Chapter 50, <br />Parks, Sections: 50 -2, Definitions, 50 -8, Smoking and 50 -14, Violations and <br />Fines of the Code of Ordinances, Cabarrus County, North Carolina, is hereby <br />amended to read as follows: <br />ARTICLE 1. IN GENERAL <br />Sec. 50 -2. Definitions <br />In the interpretation of this and succeeding Department regulations or <br />ordinances, the following terms unless otherwise defined therein, shall mean <br />the following: <br />County Building. A building owned, leased as lessor, or the area leased as <br />lessee and occupied by the County <br />Department means Cabarrus County Parks Department. <br />Employee. A person who is employed by the County of Cabarrus, or who <br />contracts with the County or a third person to perform services for the <br />County, or who otherwise performs services for the County with or without <br />compensation <br />Grounds. An unenclosed area owned, leased, or occupied by the County <br />Foot path or trail means any path or trail maintained for pedestrians. <br />Park or parks shall be deemed to include all aspects of any county park. <br />Parks System. any tract of land or body of water comprising part of the <br />County's parks, playgrounds, natural areas, recreation areas, trails and <br />greenways, and streams or other bodies of water. <br />Pedestrian means a person on foot. <br />Permit means any written license issued by or under authority of the <br />department, permitting the performance of a specified act or acts on parks <br />property. <br />
