Due <br />to threatened or pending litigation, he advised he cannot respond any further <br />at this time. <br />Chairman White advised an investigation may take on many different <br />meanings. He stated until he sees the report, he will not know what is being <br />investigated. He stated his intent to contact Ms. Juba and Mr. Daniels to <br />obtain copies of their documentation related to the incident. <br />(E) OLD BUSINESS <br />(E -1) BOC - Request for Clarification on Section 3.2 of the Incentive Grant <br />Agreement for Celgard, LLC <br />Richard Koch, County Attorney, requested clarification as to whether <br />the language from Section 3.2 of the County's Incentive Grant Program should <br />remain in Celgard's Incentive Grant Agreement based on comments made by Board <br />members at the April 19, 2010 meeting. He reported Celgard wants the grant <br />multiplier to remain at 85 percent of taxes paid on personal property assets <br />including depreciation and has agreed to include provisions related to job <br />creation and retention in the Agreement. <br />After several clarifications and a short discussion, the Board <br />authorized the County Attorney to strike from the Agreement with Celgard, <br />LLC, by consensus, the language relating to Section 3.2 of the Program. <br />(F) CONSENT AGENDA <br />(F -1) Commerce - Sewer and Water System Agreement - Pokeberry Trail <br />Cabarrus County staff is working with the City of Concord to provide <br />sewer and possibly water service to residents in Poplar Trails. The project <br />would be funded with Northwest Water and Sewer fee funds. Cabarrus County is <br />required as part of a legal settlement with Concord to expend the funds on <br />infrastructure projects in the Northwest district. No budget amendment is <br />required as funds are already in place. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the contract between Cabarrus <br />County and the City of Concord and authorized the County Manager to execute <br />the contract on behalf of Cabarrus County, subject to review or revisions by <br />the County Attorney. <br />(F -2) Finance - Adoption of Administrative Budget Amendment ($750.00), <br />Utility Special Revenue Project Ordinance <br />The Capital Reserve Utility Fund is being converted to a Special <br />Revenue Fund upon advice from the County's auditors. Specific line item <br />adjustments are detailed on the following budget amendment.
