The specifics of the agreement are as follows: • Developer - Summerhill Developers, Inc., 14675 Hopewell Church Road, Midland, NC 28107. • Payment of $4,034.00 per lot to be paid prior to final platting. • Proposed build out schedule is no more 7 single - family lots to be platted in 2010; and, no more than 7 single- family lots to be platted in 2011. The APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus County Schools indicates that schools impacted by the Deer Run Phase 3 subdivision are currently functioning at the following capacities: Bethel Elementary School - 78.690 C.C. Griffin Middle School - 126.440 Central Cabarrus High School - 82.71% Including previously approved subdivisions and additional capacity from funded improvements in the 2009 -2010 Capital Improvement Plan (CIP), these schools will be functioning at the following capacity upon completion of the Deer Run Phase 3 subdivision: Bethel Elementary School - 148.083% C.C. Griffin Middle School - 182.56% Central Cabarrus High School - 130.55% The Capital Improvements Plan (CIP) includes the A.T. Allen Elementary School replacement, projected to open in August 2010. Seating Capacity will be increased from 483 seats to 1000 seats, enabling the 95 satellite students at Bethel Elementary to return to A.T. Allen Elementary. The Patriots Elementary School, adjacent to C.C. Griffin Middle School, is also projected to open in August 2010 with capacity for 1000 students. When this new elementary school opens, 100 students will be transferred from Bethel Elementary School to the new Patriots Elementary School due to redistricting. These schools would relieve A.T. Allen, Bethel, Harrisburg and Rocky River Elementary Schools. The CIP also included Hickory Ridge Middle School, proposed to open in August 2010 with capacity for 1200 students. When this new middle school opens, 900 students will be transferred from C.C. Griffin Middle School to the new Hickory Ridge Middle School due to redistricting. Cabarrus County Schools operating at 110% capacity are considered to be operating at the maximum capacity. She stated the availability of Jerry Newton to answer any questions. Mr. Newton, representative for the developer, advised the original request with the application was for the Voluntary Mitigation Payment to be paid at building permitting. However, he stated the developer would be in agreement with payment at final platting. Ms. Morris responded to questions from the Board regarding school capacity and a discussion ensued. Mr. Newton commented on the impact the Adequate Public Facilities Ordinance and the "Permit Extension Act of 2009" has had on the developer. UPON MOTION of Commissioner Carruth, seconded by Commissioner Mynatt and unanimously carried, the Board voted to place the Consent Agreement and School Capacity Information for Deer Run Phase 3 Subdivision on the September 20, 2010 Agenda as a New Business item. Commerce - Consent Agreement and School Capacity Information for Savannah Commons Subdivision Susie Morris, Planning and Zoning Manager, presented the following information regarding a consent agreement for the Savannah Commons subdivision:
