The specifics of the agreement are as <br />follows: <br />• Developer - Summerhill Developers, Inc., 14675 Hopewell Church <br />Road, Midland, NC 28107. <br />• Payment of $4,034.00 per lot to be paid prior to final <br />platting. <br />• Proposed build out schedule is no more 7 single - family lots to <br />be platted in 2010; and, no more than 7 single- family lots to <br />be platted in 2011. <br />The APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus <br />County Schools indicates that schools impacted by the Deer Run <br />Phase 3 subdivision are currently functioning at the following <br />capacities: <br />Bethel Elementary School - 78.690 <br />C.C. Griffin Middle School - 126.440 <br />Central Cabarrus High School - 82.71% <br />Including previously approved subdivisions and additional <br />capacity from funded improvements in the 2009 -2010 Capital <br />Improvement Plan (CIP), these schools will be functioning at the <br />following capacity upon completion of the Deer Run Phase 3 <br />subdivision: <br />Bethel Elementary School - 148.083% <br />C.C. Griffin Middle School - 182.56% <br />Central Cabarrus High School - 130.55% <br />The Capital Improvements Plan (CIP) includes the A.T. Allen <br />Elementary School replacement, projected to open in August 2010. <br />Seating Capacity will be increased from 483 seats to 1000 seats, <br />enabling the 95 satellite students at Bethel Elementary to return <br />to A.T. Allen Elementary. The Patriots Elementary School, <br />adjacent to C.C. Griffin Middle School, is also projected to open <br />in August 2010 with capacity for 1000 students. When this new <br />elementary school opens, 100 students will be transferred from <br />Bethel Elementary School to the new Patriots Elementary School <br />due to redistricting. These schools would relieve A.T. Allen, <br />Bethel, Harrisburg and Rocky River Elementary Schools. <br />The CIP also included Hickory Ridge Middle School, proposed to <br />open in August 2010 with capacity for 1200 students. When this <br />new middle school opens, 900 students will be transferred from <br />C.C. Griffin Middle School to the new Hickory Ridge Middle School <br />due to redistricting. <br />Cabarrus County Schools operating at 110% capacity are considered <br />to be operating at the maximum capacity. <br />She stated the availability of Jerry Newton to answer any questions. <br />Mr. Newton, representative for the developer, advised the original request <br />with the application was for the Voluntary Mitigation Payment to be paid at <br />building permitting. However, he stated the developer would be in agreement <br />with payment at final platting. <br />Ms. Morris responded to questions from the Board regarding school <br />capacity and a discussion ensued. Mr. Newton commented on the impact the <br />Adequate Public Facilities Ordinance and the "Permit Extension Act of 2009" <br />has had on the developer. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Mynatt <br />and unanimously carried, the Board voted to place the Consent Agreement and <br />School Capacity Information for Deer Run Phase 3 Subdivision on the September <br />20, 2010 Agenda as a New Business item. <br />Commerce - Consent Agreement and School Capacity Information for Savannah <br />Commons Subdivision <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information regarding a consent agreement for the Savannah Commons <br />subdivision: <br />
