That the County Attorney is authorized to determine if the <br />proposed amendment for each Consent Agreement is in compliance with the <br />provisions of the APFO and this resolution and shall draft the amendment <br />documents. <br />4. That the amendment to each Consent Agreement shall provide that <br />the amendment will expire on September 30, 2010 unless the Board by <br />resolution extends the term of the amendment and that upon expiration, the <br />original provisions of the Consent Agreement shall again constitute the <br />contract between the parties. <br />5. That the amendment shall apply only to lots platted after the <br />effective date of this Resolution, which is March 15, 2010. <br />6. That the Cabarrus County Commerce Department shall send a copy of <br />this resolution to each affected builder or developer by regular mail at the <br />address listed in the Consent Agreement for such builder or developer. <br />WHEREAS, the expeditious administration of this extension would be <br />best served by the Board delegating to the County Manager and the County <br />Attorney the preparation and execution of these amendments; <br />NOW, THEREFORE, BE IT RESOLVED, that the CABARRUS COUNTY BOARD OF <br />COMMISSIONERS hereby resolves the following: <br />1. That all the executory provisions (Nos. 1 -5) of Resolution 2010- <br />10 shall be extended from September 30, 2010 until March 30, 2011, except <br />that the Cabarrus County Commerce Department shall not be required to send a <br />copy of this extension resolution to each affected builder or developer as <br />previously required by No. 6. <br />website. <br />2. She further <br />reported the homes of approximately five or six families will be fully <br />rehabilitated by this program in the next cycle and the homes of <br />approximately five to seven families may receive one repair item under the <br />"urgent repair" section of this grant. She encouraged interested citizens to <br />contact her at 704 - 920 -2142. <br />Chairman White opened the public hearing at 6:54 p.m. The Public <br />Hearing Notice was published on October 6 and 8, 2010 in THE INDEPENDENT <br />TRIBUNE.
