January 20, 2009 (Regular Meeting) <br />Page 1196 <br />Vice Chairman Mynatt expressed support for the motion and asked if the <br />audience will be given time to select a spokesperson and if there can be more <br />than one spokesperson. <br />Chairman White responded in the affirmative and stated his intent to <br />take a 15 minute recess to allow for the selection of spokesperson(s) if the <br />motion passes. <br />Vice Chairman Mynatt seconded the MOTION. The MOTION carried with <br />Chairman White, Vice Chairman Mynatt and Commissioners Carruth and Poole <br />voting for and Commissioner Privette voting against. <br />Recess of Meeting <br />Chairman White recessed the meeting at 7:05 p.m. to allow the opponents <br />and proponents of the land use plan to select a spokesperson(s). Chairman <br />White reconvened the meeting at 7:22 p.m. <br />- Rezoning Case <br />Chairman White asked Susie Morris, Planning and Zoning Manager, to <br />present the staff report. Ms. Morris stated Case C2008-09 is a zoning atlas <br />amendment for the Central Area Land Use Plan Implementation rezoning which is <br />an administrative rezoning with multiple property owners and multiple pin <br />numbers. She reported the existing zoning designations are: LDR, CR, MDR, <br />HDR, GI, LC and OI; and the proposed zoning designations are: A0, LI, OI, <br />LDR and CR. She reported GIS analysis determined the pin numbers involved in <br />the rezoning and that information is available; notifications were mailed to <br />individual property owners within the area if they are impacted by the <br />proposed rezoning; adjacent property owners were also notified; and <br />approximately 25 signs were erected throughout the area to inform citizens of <br />the rezoning and when the meeting was to be held. She said properties in <br />this particular area must incur zoning designation changes in order for the <br />densities to correspond to the density in the adopted plan; and the zoning <br />designations that are proposed do correspond to the Central Area Plan which <br />adopted by the Boardof Commissioners on August 18, 2008. Further, she said <br />the zoning designations currently in place are a result of the mass rezoning <br />in 2005. She said if you remember the "Designing Cabarrus" initiative, the <br />effort there was to direct densities to where utilities were available and <br />this rezoning further refines the scope of that particular project. She <br />reported the staff report is divided into five different areas and proposed <br />to review each area and then respond to questions from the Board. <br />Area 1 - Agricultural:/Rural Area North of Highwav 73 <br />Area 1 is the area north of Highway 73 and extends into Rowan County. <br />She said this particular area is proposed to be rezoned mainly to AO with the <br />exception of one parcel with institutional uses that is proposed to be <br />rezoned OI. The area with the striping is where the Land Use Plan was <br />adopted and calls for densities of one to three units per acre. She said <br />that area is proposed to be rezoned from LDR and CR mainly to A0. (Note: <br />Both areas were identified on the monitors for the benefit of the viewing <br />audience.) <br />Area 2 - South of Highway 73 and North of Highwav 99 <br />Area 2 is the area south of Highway 73 and north of Highway 49. This <br />area is bound to the west by the Utility Service Boundary (USB) line that was <br />established with the City of Concord and the proposed zoning designations for <br />this area are mainly AO and some CR. She said the proposed densities are <br />consistent with the Land Use Plan. Further, she pointed out that Highway 49 <br />serves as the USB line for the "special use district" - the area around the <br />Cabarrus Arena & Events Center, and water and sewer service is not available <br />and is not planned to be available south of Highway 49. (Note: Both areas <br />were identified on the monitors for the benefit of the viewing audience.) <br />Area 3 - South of Highwav 99 East of the Utility Service Boundarv <br />Area 3 is the ,area south of Highway 99 that extends down to Highway <br />200. That particular area is mostly proposed as Very Low Density. It is a 1 <br />to 3 unit area. The zoning designation being proposed for that area is A0. <br />There is another special use area in that area and that is the proposed <br />Atando Road working farm. (Note: Both areas were identified on the monitors <br />for the benefit of the viewing audience.) <br />
