February 2, 2009 (Work Session) Page 1235 <br />the Consent Agreement includes the payment of $9, 034.00 per lot to be paid <br />prior to final platting. <br />Joe Collins, Wyndham Estates representative, acknowledged the proposal <br />as reported by Ms. Morris. He asked the Board if it would be possible to pay <br />the Adequate Public Facilities fees at permitting. <br />Chairman White stated the Board voted to approve 11 lots to be paid at <br />final platting at the January 20, 2009 meeting. He questioned if the Board <br />could procedurally amend that vote. <br />Richard Koch, County Attorney, reported a Board member that voted with <br />the majority of the prevailing vote may call a motion to reconsider the vote. <br />A general discussion ensued with the following issues being addressed: <br />obligations in the developer's contract; platting a smaller number of lots; <br />fronting money in the current economic situation; etc. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board voted to place the Consent Agreement for <br />the Wyndham Estates Subdivision on the February 16, 2009 Agenda as an Old <br />Business item. <br />Additional Agenda Items <br />Chairman White reviewed the following list of additional items for the <br />February Agenda: <br />Recognitions and Presentations: <br />Emergency Management - Resolution Recognizing the Allen Volunteer Fire <br />Department for 50 Years of Service to Cabarrus County <br />• Cabarrus County Fair - Recognition for International and State Awards <br />Consent Agenda: <br />• Finance - 2009 Capital Project Ordinance <br />• Finance - Write-off of Ambulance Receivables for FY 2005 <br />• Tax Administration - Refund and Release Reports - January 2009 <br />• Tax Administration - Approval of 2008 Delinquent Taxes Having Liens on <br />Real Property and Advertisement Date <br />Appointments to Boards and Committees: <br />• Appointments - Adult Care Home Community Advisory Committee <br />• Appointments - Board of Equalization and Review <br />• Appointments - Cabarrus County Parks Commission <br />• Appointments - Criminal Justice Partnership Program <br />• Appointments - Nursing Home Community Advisory Committee <br />Reports: <br />• Request for Applications to County Board/Committees <br />Closed Session: <br />• Closed Session <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Poole <br />and unanimously carried, the Board approved the aforementioned items for <br />inclusion on the February 16, 2009 Agenda. <br />Adjournment <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole and <br />unanimously carried, the meeting adjourned at 5:12 p.m. <br />Cler to he ar <br />
