February 16, 2009 (Regular Meeting) <br />Page 1255 <br />Applicant Seeking Permission to Apply for Community Transportation Program <br />Funding, Enter Into Agreement with the North Carolina Department of <br />Transportation And to Provide the Necessary Assurances. <br />A motion was made by Commissioner Carruth and seconded by Vice Chairman <br />Mynatt for the adoption of the following resolution and upon being put to a <br />vote was duly adopted. <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General <br />Statutes and the Governor of North Carolina have designated the North <br />Carolina Department of Transportation (NCDOT) as the agency responsible <br />for administering federal and state public transportation funds; and <br />WHEREAS, the North Carolina Department of Transportation will apply for <br />a grant from the US Department of Transportation, Federal Transit <br />Administration and receives funds from the North Carolina General <br />Assembly to provide assistance for rural public transportation <br />projects; and <br />WHEREAS, the purpose of these transportation funds is to provide grant <br />monies to local agencies for the provision of rural public <br />transportation services consistent with the policy requirements for <br />planning, community and agency involvement, service design, service <br />alternatives, training and conference participation, reporting and <br />other requirements (drug and alcohol testing policy and program, <br />disadvantaged business enterprise program, and fully allocated costs <br />analysis); <br />WHEREAS, Cabarrus County hereby assures and certifies that it will <br />comply with the federal and state Statutes, regulations, executive <br />orders, Section 5333 (b) Warranty, and all administrative requirements <br />which relates to the applications made to and grants received from the <br />Federal Transit Administration, as well as the provisions of Section <br />1001 of Title 18, U.S.C. <br />NOW, THEREFORE, be it resolved that the County Manager of Cabarrus <br />County Board of Commissioners is hereby authorized to submit a grant <br />application for federal and state funding, make the necessary <br />assurances and certifications and be empowered to enter into an <br />agreement with the NCDOT to provide rural public transportation <br />services. <br />(G-4) BOC - Disposition of &ormer Bethel School Property <br />Mike Downs, Deputy County Manager, reported he has no new information <br />to report regarding the former Bethel School property in addition to what has <br />been previously discussed at the Board's Work Session. He requested the <br />Board provide staff with direction as to how to proceed with disposition of <br />the property. <br />Chairman White reminded the Board of several options available to the <br />Board as to how to proceed. He reported the Board could choose to do nothing <br />or to proceed under N.C.G.S. ~ 160A-266 which allows for the disposition of <br />the property using one of the following procedures: 1) private negotiation <br />and sale; 2) advertisement for sealed bids; 3) negotiated offer, <br />advertisement, and upset bid; 4) public auction; or 5) exchange. Chairman <br />White stated that a proposal to lease the property had been submitted to the <br />Town of Midland. <br />John Day, County Manager, stated an additional method of sale would be <br />to use N.C.G.S. ~ 158-7.1 to enable economic development. Mr. Day explained <br />that you can negotiate a sale with an individual or firm that will use the <br />property to create jobs in some fashion. He stated the statute is very <br />broad. <br />Richard Koch, County Attorney, reminded the Board the First Union Bank <br />Building was sold using N.C.G.S. § 158-7.1. <br />Commissioner Carruth stated he has learned from Midland Mayor Pro <br />Tempore Kathy Kitts and Midland Town Councilman Mike Tallent that there is an <br />organization interested in the property. He further stated the availability <br />of Mayor Pro Tempore Kitts and/or the nonprofit to make a short presentation. <br />
