April 6, 2009 (Work Session) <br />Page 1299 <br />The Board of Commissioners for the County of Cabarrus met for an Agenda <br />Work Session meeting in the Multipurpose Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, April 6, 2009, at <br />3:30 p.m. <br />Present - Chairman: H. Jay White, Sr. <br />Vice Chairman: Grace M. Mynatt <br />Commissioners: Robert W. Carruth <br />Elizabeth F. Poole <br />Coy C. Privette <br />Also present were John Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; Kay Honeycutt, Clerk to the Board and Lyndsay Hayes, Deputy Clerk to <br />the Board. <br />Call to Order <br />Chairman White called the meeting to order at 3:37 p.m. <br />Commerce - Property Line Adjustment with Piedmont Preservation Foundation <br />Richard Koch, County Attorney, presented information related to the <br />property line adjustment with Piedmont Preservation Foundation. He reported <br />work is still being done to correct the front property line which allows <br />access to Corban Avenue; other issues exist involving a title and easement <br />belonging to Saint James Lutheran Church; etc. He stated the item will be <br />ready for the Board's review at the May regular meeting. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board voted to place the property line <br />adjustment with Piedmont Preservation Foundation on the May 18, 2009 Agenda <br />as an Old Business item. <br />Finance - Resolution Approving Installment Contract Financing for Various <br />Public School Projects in an Aggregate Principal Amount up to $117,000,000.00 <br />Vice Chairman Mynatt announced the presence of Dr. Barry Shepherd, <br />Cabarrus County Schools Superintendent, and requested this item be discussed <br />as soon as possible so that Dr. Shepherd may leave to attend a school board <br />meeting. <br />Pam Dubois, Deputy County Manager, presented a request for a resolution <br />approving installment contract financing for various public school projects <br />in an aggregate principal amount up to $117,000,000.00. She reported the <br />following: previously, the County requested an amount not to exceed $130 <br />million; bids are being received substantially lower than anticipated; and <br />once all information is received, another debt service schedule will be <br />completed to produce a final number. <br />Dr. Barry Shepherd, Cabarrus County Schools Superintendent, addressed <br />the following issues: the possibility of current bids being too low; the <br />need for a larger contingency because of low bids; the possibility of a <br />higher than normal number of change orders on these projects; etc. <br />In response to questions from Chairman White, John Day, County Manager, <br />explained the following: to ensure work is completed, the County should <br />require a performance bond; one architect has expressed concern that there <br />might be an effort to get several change orders approved to make up for low <br />bids; there should be a very careful review of bids received; if an <br />extraordinary amount of contingency is requested, the approval of the Local <br />Government Commission (LGC) is required; the normal amount of contingency <br />requested is 3-5 percent; 10-15 percent of contingency has been suggested by <br />one architect; etc. A brief discussion ensued regarding performance bonds. <br />Mike Downs, Deputy County Manager, commented that low bids were also <br />received for the jail construction, and allowances were included to be used <br />for specific purposes instead of contingency. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board voted to place the Resolution Approving <br />Installment Contract Financing for Various Public School Projects in an <br />Aggregate Principal Amount up to $117,000,000.00 on the April 20, 2009 Agenda <br />as a New Business item. <br />
