April 6, 2009 (Work Session) <br />Page 1301 <br />The Capital Improvements Plan (CI P) includes a new elementary <br />school in 2013 in the northwest area with capacity for 800 <br />students. When this new school opens, 800 students will be <br />transferred from W.R. Odell Elementary School to the new <br />elementary school due to redistricting. <br />A new 1200 seat middle school is included in the plan for 2009 in <br />the northwest/Weddington Road area of the County. When this new <br />school opens, 700 students will be transferred from Harris Road <br />Middle School to the new middle school due to redistricting. <br />Cox Mill High School is scheduled to open August 2009 with <br />capacity for 1950 students. When this new school opens, 1450 <br />students will be transferred from Northwest Cabarrus High School <br />to the new high school due to redistricting. <br />Cabarrus County Schools operating at 1108 capacity are considered <br />to be operating at maximum capacity. <br />Ms. Morris stated the availability of Mr. Calvin Kiser, representative <br />of Triune Development, LLC., to answer questions. She reported the <br />following: the Adequate Public Facilities Ordinance (APFO) Mitigation payment <br />will be $4,039.00 per unit; the developer is requesting the payments for the <br />first 28 units be paid at permitting, with the remaining 42 lots being paid <br />at final platting; the developer also wishes to restructure the build-out <br />schedule. <br />In response to several questions from the Board, Calvin Kiser, <br />representative of Triune Development, reported the following: the developers <br />are requesting a delay in APFO payments due to poor economic conditions; a <br />lot of change orders have been required; issues have arisen regarding <br />engineering and easements; the developers can record lots as they are sold, <br />however, there is no benefit nor detriment for doing so; etc. Discussions <br />continued regarding platting fees, easement issues, etc. <br />Ms. Morris explained to the Board the developers' consent agreement has <br />expired and needs to be renegotiated. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />and unanimously carried, the Board voted to place the Consent Agreement for <br />the Castlebrook Manor Subdivision on the April 20, 2009 Agenda as a New <br />Business item. <br />- Adequate Public Facilities Mitigation Agreement for Jacob's <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information regarding the Adequate Public Facilities Mitigation Agreement for <br />Jacob's Landing Townhomes: <br />Coddle Creek Development Group, LLC., (2904 Concord Highway, <br />Monroe, NC 28110) is requesting an Adequate Public Facilities <br />Mitigation Agreement (APFMA) for the Jacob's Landing Townhome <br />project, which consists of 153 townhome units on +/- 21.43 acres <br />located at the intersection of Pitts School Road and NC Highway <br />29 North in the City of Concord, North Carolina. The project <br />received a preliminary plat approval from the City of Concord <br />Planning and Zoning Commission on January 15, 2008. <br />The Cabarrus County Board of Commissioners approved a Reservation <br />of Capacity for the Jacob's Landing Townhomes project on June 16, <br />2008 subject to the following conditions: <br />Reservation of Capacity Terms of Approval <br />1. This Certificate applies to the development of no more than <br />153 townhome units on the following parcel: (1) 5509-43-8979. <br />2. Coddle Creek Development Group, LLC will not be required to <br />adhere to a build out schedule. <br />3. Coddle Creek Development Group, LLC will not pay the Voluntary <br />Mitigation Payment. <br />
