April 6, 2009 (Work Session) Page 1307 <br />A brief discussion ensued. <br />Petitions to Appeal the Central Area Land Use Plan <br />John Day, County Manager, reminded the Board that when the Central Area <br />Land Use Plan was adopted, the Board allowed the filing fees for those who <br />filed a zoning petition to be waived. He asked the Board to provide <br />direction as to whether the filing fees associated with appealing the <br />decision from the Planning and Zoning Commission will be waived. <br />Susie Morris, Planning and Zoning Manager, reported if someone wants to <br />file an appeal of the Planning and Zoning Commission decision, signs are <br />posted and advertisements run in the local newspaper. She stated an appeal <br />would be heard before the Board of Commissioners at a de novo hearing. <br />A brief discussion ensued. Commissioner Carruth was in favor of <br />waiving the fee. <br />Chairman White asked that Ms. Morris make it abundantly clear at all <br />hearings that applicants only have 15 days to appeal the decision of the <br />Planning and Zoning Commission to the Board of Commissioners. <br />Update from Commissioner Carruth <br />Commissioner Carruth announced that at a North Carolina Association of <br />County Commissioners' (NCACC) meeting, bills regarding Adequate Public <br />Facilities Ordinances, Transfer Taxes, and Tax Deferrals were discussed. He <br />also announced that NCACC County Assembly Day will be held on April 29, 2009 <br />in Raleigh, North Carolina. <br />Future Meetings <br />Chairman White reported that UNC-Charlotte's Urban Institute will be <br />holding a regional forum to discuss the Citistates Report at the Cabarrus <br />Arena and Events Center on April 23, 2009 from 1:00 p.m. to 3:30 p.m. He <br />stated the Board has also scheduled a "Budget Preview" meeting on April 23 to <br />begin at 3:30 p.m. A brief discussion ensued on possibly rescheduling the <br />budget preview meeting. <br />John Day, County Manager, stated that staff will not be recommending a <br />tax increase this year and the economy should not have any impact on the <br />services provided by the County. He pointed out there is not a lot of <br />flexibility in this year's budget and questioned the value of having the <br />budget preview meeting. <br />Pam Dubois, Deputy County Manager, stated staff can provide a brief <br />snapshot and preliminary projections for the upcoming budget year at the May <br />9, 2009 Agenda Work Session. <br />Chairman White accepted Ms. Dubois' offer and stated the April 23 <br />meeting would not be needed. He also encouraged other Board members to <br />attend the Citistates Report forum. Mr. Day also asked that the forum be <br />recorded for broadcasting on Channel 22. <br />Chairman White also announced a meeting will be held on April 15, 2009 <br />at either 10:00 a.m. or 5:30 p.m, to meeting with Congressman Kissell. He <br />stated the meeting will last for approximately one hour. <br />Additional Agenda Items <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole, <br />and unanimously carried, the Board voted to remove the Communications and <br />Outreach - County Government Week Celebration Proclamation item from the <br />Consent Agenda and placed it on New Business for discussion. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette, <br />and unanimously carried, the Board approved the following list of additional <br />items for the April 20, 2009 Agenda: <br />Recognitions and Presentations: <br />• Proclamation Recognizing North Carolina 4-H's 100`" Anniversary <br />Consent Agenda: <br />
