Furr - Zoning Atlae Amendment <br />to Rezone Property from AO to CR <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information regarding Rezoning Case 2009-13(R)- Kenneth P. Furr: this is a <br />request to rezone approximately 32 acres from Agricultural Open (AO) zoning <br />designation to Countryside Residential (CR) designation; the property is <br />currently being used as residential and agricultural; the subject property is <br />located inside the City of Concord's utility service area, but outside the <br />service boundary that was established as part of the Central Area Land Use <br />Plan (CALUP); the subject property is designated as Rural residential; the <br />property is zoned AO and is surrounded by properties zoned as A0; the CR <br />densities are not consistent with the Rural Residential densities proposed in <br />the CALUP; this is a conventional rezoning request; all uses permitted in the <br />CR district would be permitted if the request to rezone is approved; and <br />based on the land use designation assigned by the CALUP, the proposed <br />rezoning from AO to CR is not consistent with the densities discussed in the <br />CALUP; therefore, the Board should review the information and facts presented <br />to determine if the rezoning is consistent with the goals and vision for this <br />area. <br />Chairman White opened the public hearing at 9:56 p.m. The Public <br />Hearing Notice was published on May 8 and 15, 2009 in THE INDEPENDENT <br />TRIBUNE. The Public Hearing Notice was also posted on the Cabarrus County <br />website on May 7, 2009. <br />Darrell Furr, 3800 Cold Springs Road South, Concord, stated the subject <br />property was inherited by his mother and the family may want to build a few <br />houses on the property in the future for nieces and nephews since the land <br />perks. He expressed a desire for smaller lots; commented on the possibility <br />of using the land for forestry purposes; and commented on development <br />pressure from Concord. <br />With there being no one else to address the Board, Chairman White <br />closed the public hearing. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Mynatt <br />with Chairman White, Vice Chairman Mynatt, and Commissioners Carruth and <br />Poole voting for and Commissioner Privette voting against, the Board denied <br />the rezoning request for Parcel Identification Number 5548-83-7609, Case <br />2009-13(R) - Kenneth P. Furr. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Poole, <br />and unanimously carried, the Board adopted the following Consistency <br />Statement as it relates to rezoning case 2009-13 (R) - Kenneth P. Furr, Parcel <br />Identification Number 5598-83-7609: the proposed rezoning is not consistent <br />with the Central Area Land Use Plan and it is not reasonable and is not in <br />the public interest because it is not consistent with the plan and the <br />surrounding properties are zoned Agricultural Open and of similar use. <br />(C-12) Rezoning Case 2009-14 (R) - Kenneth P. Furr and Wife - Zonin Atlas <br />Amendment to Rezone Property from AO to CR <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information regarding Rezoning Case 2009-14(R)- Kenneth P. Furr and Wife: <br />this is a request to rezone approximately 18 acres from Agricultural Open <br />(AO) zoning designation to Countryside Residential (CR) designation; the <br />subject property is located in the City of Concord's service area, but is <br />located outside the utility service boundary established as part of the <br />Central Area Land Use Plan (CALUP); the request for CR is not consistent with <br />the Rural Residential land use classification as set forth in the CALUP; this <br />is a conventional rezoning request; all uses in the CR district would be <br />permitted if the request to rezone is approved; and based on the land use <br />designation in the CALUP, the proposed rezoning from AO to CR is not <br />consistent with the densities discussed in the plan; therefore, the Board <br />should review the information and facts presented to determine if the <br />proposed zoning map amendment is appropriate. <br />Chairman White opened the public hearing at 5;00 p.m. The Public <br />Hearing Notice was published on May 8 and 15, 2009 in THE INDEPENDENT <br />TRIBUNE. The Public Hearing Notice was also posted on the Cabarrus County <br />website on May 7, 2009. <br />
