September 21, 2009 (Regular Meeting) <br />Page 1580 <br />classification and salary recommendations, and reasons for the selection. <br />After considering the department head's comments, the County Manager shall <br />make the appointment and determine the classification and starting salary. <br />Appointing authorities other than the County Manager shall forward the <br />employee's name to the Human Resources Director with classification and <br />salary recommendations. <br />Section 13. Demotion <br />Any employee whose work in his present position is unsatisfactory, or whose <br />personal conduct is unsatisfactory, may be demoted, provided that the <br />employee shows promise of becoming a satisfactory employee in another <br />position. Such a demotion shall follow the procedures outlined in Article <br />VII, Section 2. An employee may request a demotion on a strictly voluntary <br />basis subject to approval of the department head and County Manager. <br />Section 14. Transfer <br />If a vacancy occurs and an employee is eligible for a transfer and is <br />selected, the department head wishing to hire the employee shall request the <br />transfer, which is subject to review by the Human Resources Director and <br />approval of the County Manager, except that appointing authorities other than <br />the County Manager shall make such appointments for their departments. Any <br />employee involuntarily transferred may appeal the action in accordance with <br />the grievance procedures outlined in Article VIII. <br />Section 15. Emergency Appointment <br />An emergency appointment may be made when a situation exists requiring the <br />services of an employee before it is possible to identify a qualified <br />applicant through the regular selection process. When it is determined by the <br />County Manager or appointing authority that an emergency appointment is <br />necessary, all other requirements for appointment will be waived. An <br />emergency appointment may be made for a period of up to 60 work days <br />(consecutive or non-consecutive). Any one individual may not receive <br />successive emergency appointments with the same department or agency. At <br />least three calendar months must elapse before an individual may receive <br />another emergency appointment. <br />Section 16. Employment Screening <br />Cabarrus County requires position appropriate pre-employment, promotion, and <br />reassignment screenings to include, credit, criminal, driving, drug, <br />educational, and reference information. Authorization by the individual being <br />considered for hire, promotion, or reassignment is required prior to <br />screening. <br />Article V. Conditions of Employment <br />Section 1. Workweek <br />County employees are subject to an 8:00 AM to 5:00 PM Friday through Thursday <br />workweek and to the overtime and/or compensatory time provisions as set forth <br />in Appendix B, Wage and Hour Policy. Law enforcement personnel require a work <br />period to accommodate a 29 hour, 14 day work schedule. EMS Personnel require <br />a work schedule to accommodate an on duty 29, off duty 98 hour work schedule. <br />Other workweek schedules may be authorized by the County Manager in keeping <br />with the Fair Labor Standards Act and County needs. <br />Employees in positions determined to be exempt under the Fair Labor Standards <br />Act shall work the number of hours necessary to assure the satisfactory <br />performance of their duties. <br />Office hours for all County departments shall extend from 8:00 AM until 5:00 <br />PM on Monday through Friday. However, when the activities of a particular <br />department require another schedule to meet work needs, the County Manager <br />may authorize a deviation from the normal schedule. <br />Employees will report to work as scheduled and on time. <br />Section 2.
