September 21, 2009 (Regular Meeting) Page 1587 <br />during the calendar year shall be credited sick leave at the rate of 3 hours, <br />91 minutes and 32 seconds for each completed bi-weekly pay period, or 95 <br />hours, 59 minutes and 52 seconds for each completed year (52 weeks) of <br />service. <br />Emergency Medical Service 29/48 personnel shall be credited sick leave at the <br />rate of 5 hours, 9 minutes and 13 seconds for each completed bi-weekly pay <br />period, or 133 hours, 59 minutes and 13 seconds for each completed year (52 <br />weeks) of service. Law enforcement officers working a 12 hour shift schedule <br />shall be credited sick leave at the rate of 3 hours, 52 minutes, and 36 <br />seconds for each completed biweekly pay period, or 100 hours, 47 minutes, and <br />51 seconds for each completed year (52 weeks) of service. These employees <br />shall be charged on an hour for hour basis for sick leave taken. <br />Sick leave credited to regular and probationary employees scheduled to work <br />at least 1,000 hours during the calendar year but fewer hours than the basic <br />work week shall be determined in accordance with the formula set forth in <br />Section 15 of this Article. <br />Section 10. Advance Sick Leave <br />The County Manager may advance sick leave to an employee who has exhausted <br />sick leave because of a major operation or illness. This advanced sick leave <br />may not exceed 80 hours, except with the approval of the Board of <br />Commissioners. <br />At the time of an employee's separation, any sick leave owed the County shall <br />be deducted from the employee's final compensation or collected from him or <br />her, if not available in his or her final compensation. <br />Section 11. Sick Leave - Maximum Accrual <br />There is no limit on the amount of sick leave that may be accrued. <br />Section 12. Sick Leave - Medical Documentation <br />The employee's supervisor or department head may require medical <br />documentation concerning the nature of an illness and/or employee's physical <br />capacity to resume duties for each occasion on which an employee uses sick <br />leave to insure that there is no abuse of sick leave privileges. <br />Section 13. Sick Leave - Retirement Credit for Accrued Sick Leave <br />One month of retirement credit is allowed for each 20 days and part thereof <br />accrued in an employee's sick leave account at time of retirement to <br />employees who are members of the North Carolina Local Governmental Employees' <br />Retirement System or Law Enforcement Officers' Benefit and Retirement Fund. <br />Section 14. Sick Leave - Credit from Previous Employment <br />Employees hired after the effective date of this Ordinance and previously <br />employed by a governmental entity in North Carolina will receive credit with <br />Cabarrus County for up to 20 days sick leave accrued at that entity. In <br />extraordinary circumstances the County Manager may grant additional credit of <br />transferable hours. Accrued sick leave over 20 days will be credited the pay <br />period of separation from County employment. The employee must have been <br />employed by the governmental entity immediately prior (within the last 30 <br />days) to County Employment and that entity must document the accrued sick <br />leave amount and that the employee was not reimbursed for any portion of the <br />reported leave. <br />Section 15 Calculation of Vacation and Sick Leave for Part time Employees <br />Vacation leave and sick leave credited to regular and probationary employees <br />scheduled to work at least 1,000 hours during the calendar year and having a <br />work week with fewer hours than the basic work week, shall be determined in <br />accordance with the following formula: <br />(a)The number of hours worked by such an employee in their normal work week <br />shall be divided by the number of hours in the basic work week of a <br />regular full time employee in a like or similar position. <br />(b)The percentage obtained in (a) shall be used to obtain the prorated amount <br />
