The Public Hearing Notice was also posted on the County's website (www.cabarruscounty.us) on November 5, 2009 in accordance with Article 2, Administration, Section 2.1 (Use of Electronic Means to Provide Public Notices) of the Cabarrus County Code of Ordinances. There was no one present to address the Board; therefore, Chairman White closed the public hearing. UPON MOTION of Commissioner Poole, seconded by Commissioner Carruth and unanimously carried, the Board adopted the following Ordinance (TEXT2009- 00011) amending the Cabarrus County Zoning Ordinance: Ordinance No. 2009-17 AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE TEXT2009-00011 BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as follows: Amend Chapter 4, Part II, Waterbody Buffer Zone as follows: DELETE current Chapter 4, Part II, Waterbody Buffer Zone text ADD new Chapter 9, Part II, Waterbody Buffer Zone text Adopted this the 16t" day of November, 2009 by the Cabarrus County Board of Commissioners. /s/ H. Susie Morris, Planning and Zoning Manager, reviewed proposed changes to the Cabarrus County Zoning Ordinance identified in Text Amendment No. TEXT2009-00009. The proposed text amendment permits a limited number of female chickens in the LDR (Low Density Residential) and MDR (Medium Density Residential) zoning districts. Chairman White reviewed concerns discussed at the work session relating to health issues, safety, policing, and noise. Ms. Morris advised those issues would be handled through the Zoning Ordinance and violations of such will result in zoning enforcement actions. She noted, according to the Ordinance, chickens would be contained in a chicken house or run which should eliminate noise and the possibility of chickens flying to other properties.
