December 7, 2009 (Work Session) Pa e 1703 <br />9 <br />The Board of Commissioners for the County of Cabarrus met for an Agenda <br />Work Session in the Multipurpose Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, December 7, 2009 at 3:30 p.m. <br />Present - Chairman: H. Jay White, Sr. <br />Vice Chairman: Grace M. Mynatt <br />Commissioners: Robert W. Carruth <br />Elizabeth F. Poole <br />Coy C. Privette <br />Also present were John Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; Kay Honeycutt, Clerk to the Board and Cynthia Young, Deputy Clerk to <br />the Board. <br />Call to Order <br />Chairman White called the meeting to order at 3:27 p.m. <br />Changes to the Agenda <br />UPON MOTION of Commissioner Poole, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the Agenda with the following <br />changes: <br />Removal: New Business <br />G-13 Commerce Department - Reservation of Capacity Certificate - The <br />Oaks at Stephens Place Project <br />Addition: Reports <br />I-2 Commerce - Census Complete County Committee Update / Jonathan <br />Marshall, Commerce Director <br />Additional Agenda Items <br />UPON MOTION of Commissioner Poole, seconded by Vice Chairman Mynatt and <br />unanimously carried, the Board approved the following list of additional <br />items to be placed on the December 21, 2009 Agenda: <br />Consent Agenda <br />• Finance - Establish Debt Service for 2009 Certificates of Participation <br />(COPS) $3,802,349.22 <br />• Finance - Partial Close-out of the Sheriff Administration/Annex <br />Construction Project Fund ($2,570,644.54) <br />• Finance - Property Easements for the AT Allen Replacement Elementary <br />School - $17,810.80 <br />• Sheriff's Department - Approval of Bid from Hilbish Motor Company for <br />Six (6) Ford Crown Victoria Police Interceptor Vehicles - $127,410.00 <br />• Tax Administration - Refund and Release Report - November 2009 <br />Appointments <br />• Appointments - Commissioner Appointments for Calendar Year 2010 <br />• Appointments - Department of Aging Advisory Board <br />• Appointments Library Board of Trustees <br />• Appointments/Removal - Nursing Home Community Advisory Committee <br />Reports <br />• Request for Application to County Boards/Committees <br />BOC - Discussion of Business Personal Property Investments as Related to the <br />County's Incentive Grant Program <br />Chairman White reviewed information relating to SBM Solar, Inc.'s <br />request for an incentive grant which is solely for equipment (personal <br />property). He spoke briefly about concerns regarding personal property, in <br />particular, incentivizing equipment and how the County can protect its <br />interest in such an instance. A discussion ensued regarding a few companies <br />that were previously involved in a similar situation pertaining to incentive <br />grants on personal property. Further discussions involved how depreciation <br />would factor into SBM Solar's assets; the IRS's and the County's depreciation <br />process; and how the County would be protected by the clawback provision <br />incorporated in the draft agreement. <br />
