December 21, 2009 (Regular Meeting) <br />P. <br />must provide additional information within a time per: <br />specified in the bid document. This bidder must provide either: <br />a. An affidavit describing the portion of the work to be <br />executed by minority businesses, expressed as a percentage <br />of the total contract amount; or, <br />b. Documentation of good faith efforts to meet the goal, <br />including any advertisements, solicitations, and evidence <br />of other specific actions demonstrating recruitment and <br />selection of minority businesses for participation in the <br />contract. <br />10. Administration, Enforcement, Reporting - The County is <br />required to submit reports on each building project to the <br />Department of Administration. The reports must include: <br />a. The verifiable percentage goal (Cabarrus County has <br />established a verifiable percentage goal of 10%) <br />b. The minority business utilization achieved, the good <br />faith efforts guidelines or rules used, and the <br />documentation accepted by the County from the successful <br />bidder; and, <br />c. The utilization of minority businesses under the various <br />construction methods authorized under NC General Statute <br />143-128. The subject reports must be prepared in the <br />specific format determined by the Department of <br />Administration and submitted upon completion of each <br />project. <br />II. INFORMAL BIDS ($5,000 - $499,999.99) <br />An informal bidding procedure may be used for construction or <br />repair contracts involving the expenditures of $5,000 or more, <br />but less than $500,000. <br />Legal Requirements <br />The Statutes do not specify procedures for advertising and <br />receiving informal bids or require a specific number of bids <br />before a contract can be awarded. The County may choose to use a <br />formal or informal process to solicit bids for construction <br />projects less than $500,000. <br />1. Performance and payment bonds are required for each <br />contract that exceeds $50,000. <br />2. Contracts must be awarded to the "lowest responsible <br />bidder, taking into consideration quality, performance and <br />the time specified for the performance of the contract." <br />3. Minority participation should be solicited and efforts must <br />be documented. <br />Upon completion of the project, a report must be submitted to the <br />Department of Administration, Office of Historically <br />Underutilized Business. The report must include the type of the <br />project, total dollar amount of the project, dollar value of <br />minority business participation on each project, and <br />documentation of efforts to recruit minority participation. <br />III. Selection of Architect, Engineer or Surveyor <br />Pursuant to NC General Statute 133-1.1(a), plans and <br />specifications for public projects must be prepared by a <br />registered architect or engineer when (1) new construction or <br />repairs involving major structural or foundation changes with <br />expenditures totaling $135,000 or more, (2) repairs not involving <br />structural or foundation changes with, expenditures totaling <br />$500,000 or more, and (3) work affecting life safety systems when <br />the expenditure is $100,000 or more. <br />Legal Requirements <br />Selection of a project designer; use of a registered architect or <br />engineer is governed by North Carolina General Statutes which <br />states the following requirements: <br />1. All requirements for architectural, engineering and <br />surveying services must be announced and obtained through a <br />Request for Qualifications (RFQ) process. <br />2. Selection of qualified firms to provide services must be on <br />the basis of demonstrated competence and qualifications for <br />
