March 29, 2008 (Regular Meeting) Page 763
The original MOTION carried with Chairman White, Vice Chairman Juba and
Commissioners Carruth and Mynatt voting for and Commissioner Privette voting
against.
(G-2) Amendment to the Cabarrus County Code of Ordinances - Of£enaea and
Miscellaneous Provisions, Section 46-4 - Public Hearing 6:30 p.m.
John Day, County Manager, presented information related to repeal
Section 96-9 of the Cabarrus County Code of Ordinances, Offenses and
Miscellaneous Provisions. He distributed an amendment prepared by the County
Attorney that would prohibit the carrying of weapons on County property by
all those who are not permitted to do so by Statue. He also reported there
currently is no prohibition of carrying weapons on county property with the
exception of those who have a permit for concealed weapons. In summary, he
said anyone can carry a weapon expect those who are permitted to do so by the
State. He also mentioned the recent incident in Missouri and said securing
the Governmental Center is nearly impossible.
Richard Koch, County Attorney, responded to questions from the Board
related to the amendment and carrying concealed weapons in County parks. In
response to an inquiry from Chairman White, Mr. Koch reported he is working
on the issue related to County employees handling their weapons safely.
Chairman White opened the public hearing at 7:06 p.m. The Public
Hearing Notice was published on March 13, 2008 in THE INDEPENDENT TRIBUNE and
in THE CHARLOTTE OBSERVER (Cabarrus Neighbors).
There was no one present to address the Board; therefore, Chairman
White closed the public hearing.
Vice Chairman Juba MOVED to adopt the ordinance rescinding Section 96-9
of the Cabarrus County Code of Ordinances.
A discussion ensued on rescinding the ordinance versus adopting the
amendment; holding a second public hearing; the wording of the public hearing
notice; and tabling this item until April 7, 2008 meeting.
Upon consultation with the County Attorney and the County Manager, it
was determined the ordinance could be amended to read as presented in the
handout prepared by the County Attorney.
Vice Chairman Juba withdrew her MOTION to adopt the ordinance
rescinding Section 96-9 of the Cabarrus County Code of Ordinances and MOVED
to amend Section 96-9 to read as presented. Commissioner Carruth seconded
the motion. The MOTION unanimously carried.
The Ordinance is as follows:
Ordinance No. 2008-09
AN ORDINANCE AMENDING
THE CABARRUS COUNTY CODE OF ORDINANCES
CHAPTER OFFENSES AND MISCELLANEOUS PROVISIONS
Section 96-9
Existing Text
Sec. 96-9.
