March 29, 2008 (Regular Meeting) Page 763 <br />The original MOTION carried with Chairman White, Vice Chairman Juba and <br />Commissioners Carruth and Mynatt voting for and Commissioner Privette voting <br />against. <br />(G-2) Amendment to the Cabarrus County Code of Ordinances - Of£enaea and <br />Miscellaneous Provisions, Section 46-4 - Public Hearing 6:30 p.m. <br />John Day, County Manager, presented information related to repeal <br />Section 96-9 of the Cabarrus County Code of Ordinances, Offenses and <br />Miscellaneous Provisions. He distributed an amendment prepared by the County <br />Attorney that would prohibit the carrying of weapons on County property by <br />all those who are not permitted to do so by Statue. He also reported there <br />currently is no prohibition of carrying weapons on county property with the <br />exception of those who have a permit for concealed weapons. In summary, he <br />said anyone can carry a weapon expect those who are permitted to do so by the <br />State. He also mentioned the recent incident in Missouri and said securing <br />the Governmental Center is nearly impossible. <br />Richard Koch, County Attorney, responded to questions from the Board <br />related to the amendment and carrying concealed weapons in County parks. In <br />response to an inquiry from Chairman White, Mr. Koch reported he is working <br />on the issue related to County employees handling their weapons safely. <br />Chairman White opened the public hearing at 7:06 p.m. The Public <br />Hearing Notice was published on March 13, 2008 in THE INDEPENDENT TRIBUNE and <br />in THE CHARLOTTE OBSERVER (Cabarrus Neighbors). <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />Vice Chairman Juba MOVED to adopt the ordinance rescinding Section 96-9 <br />of the Cabarrus County Code of Ordinances. <br />A discussion ensued on rescinding the ordinance versus adopting the <br />amendment; holding a second public hearing; the wording of the public hearing <br />notice; and tabling this item until April 7, 2008 meeting. <br />Upon consultation with the County Attorney and the County Manager, it <br />was determined the ordinance could be amended to read as presented in the <br />handout prepared by the County Attorney. <br />Vice Chairman Juba withdrew her MOTION to adopt the ordinance <br />rescinding Section 96-9 of the Cabarrus County Code of Ordinances and MOVED <br />to amend Section 96-9 to read as presented. Commissioner Carruth seconded <br />the motion.
