March 24, 2008 (Regular Meeting) Page 765
for and Chairman White abstaining, the Board voted to reject the offer by the
Town of Midland to purchase right-of-way at the Rocky River Elementary School
for the purpose of the extension of the Monroe Natural Gas Pipeline.
Commissioner Carruth asked the County Attorney to investigate options
related to condemnation in the Agricultural Districts.
(G-4) Solid Waste Management - Mulch Give-Away
Rick Payne, Solid Waste Manager, presented a request to offer free
mulch to Cabarrus County citizens during the week of April 19-26, 2008, in
observance of Earth Day. There was a brief discussion and Commissioner White
asked Mr. Payne to track how much mulch is given away that week.
UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt and
unanimously carried, the Board voted to waive the fee for mulch during the
week of April 19-26, 2008 in observance of Earth Day.
(G-51 Fishertown - Potential Infrastructure Extension Scenarios
Kelly Sifford, Community Development Manager, presented information
related to infrastructure extension scenarios for the Fishertown community.
She reported the Board, at its March work session, decided not to be included
in a letter mailed to Fishertown residents from the City of Kannapolis. In
addition, she said a fact sheet was mailed with the letter identifying the
costs associated with annexation, additional services to be provided and
dates for two upcoming informational sessions. She said Kannapolis estimates
the project to cost approximately $6.5 million, anticipates there will not be
enough revenue to cover debt service and provided the following two options:
(1) annex the community and put them on a waiting list behind other
communities already in line; or (2) maintain status quo. She further
reported on two possible alternate courses of action: (1) the County becomes
a funding partner; and (2) the County pursues and receives Federal grant
funding. She stated the Fishertown community is not a competitive area for
grants.
There was a general discussion on the subject. The following issues
were addressed: the status of the survey; was the project included in the
TIF financing; cost to the residents if annexed by Kannapolis; possible grant
funding; etc.
Several Board members expressed a desire to wait until the survey has
been completed before taking action and a discussion on failed septic tanks
ensued.
UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Juba and
unanimously carried, the Board voted to place the Fishertown - Potential
Infrastructure Extension Scenarios back on the work session agenda as soon as
the survey results are provided by Kannapolis.
(G-6) Reservation of Capacity Certificate for the Hurnt Mill Subdivision
As the owner/developer of the Burnt Mill Subdivision, Commissioner
Mynatt MOVED to recuse herself from the vote related to the Reservation of
Capacity Certificate for the Burnt Mill Subdivision. Commissioner Carruth
seconded the motion. The MOTION unanimously carried.
Susie Morris, Planning and Zoning Manager, presented the following
information related to a Reservation of Capacity Certificate for the Burnt
Mill Subdivision project:
Burnt Mill Development, LLC (1980 Highway 73 East, Concord, NC
28025) requests a reservation of capacity for Burnt Mill
Subdivision, which consists of 25 single-family residential lots
on +/- 90 acres located at the intersection of NC Highway 73 and
Crestmont Road in unincorporated Cabarrus County.
School Capacity Review
Burnt Mill subdivision will produce 14 students. The schools
impacted by the subdivision are W.M. Irvin Elementary School,
Concord Middle School and Concord High School.
The County's Capital Improvements Plan (CIP) includes
construction of an A.T. Allen Elementary replacement in 2009.
