April 21, 2008 (Regular Meeting) <br />Page 799 <br /> Capacity 2 Yrs 5 Yrs <br />Weddington Hills Elementary 11 11 11 <br />Concord Middle School 195 195 195 <br />Concord High School 969 989 989 <br />This table assumes that no redistricting occurs either before or <br />after the new schools planned or under construction are opened. <br />Adequacy Determination <br />As illustrated above, adequate school capacity does not exist <br />currently for this apartment project nor does it exist at the two <br />year and five year review levels for the elementary school. (Note <br />that according to Section 15-11, Number 4, of the APFO, "...future <br />available capacity must be "...equal to or greater than the <br />projected enrollment that will be produced by the proposed <br />development for all school types," notjust one or two.) <br />Recommendation <br />Based on the direction of the Board of Commissioners, until <br />changes are implemented in the ordinance, staff proposes the <br />following: <br />1. The applicant is proposing the following phasing schedule: <br />In calendar year 2008, no more than 8 multi-family <br />apartment units permitted; <br />In calendar year 2009, no more than 11 multi-family <br />apartment units permitted; <br />In calendar year 2010, no more than 11 multi-family <br />apartment units permitted; <br />In calendar year 2011, no more than 11 multi-family <br />apartment units permitted; <br />In calendar year 2012, no more than 11 multi-family <br />apartment units permitted; <br />In calendar year 2013, no more than 116 multi-family <br />apartment units permitted. <br />2. Mitigation of the pro-rata share of the cost of planned <br />capacity, which equals $9,153.00 per multi-family <br />residential apartment unit, payable prior to building <br />permitting. <br />Ms. Watts also stated the availability of Mark McCormick to respond to <br />questions. <br />Commissioner Carruth commented on the uniqueness of the situation-being <br />the first time when all the capacity numbers are a positive number. He also <br />confirmed with Ms. Watts that after the students generated from this <br />development are factored into the equation, there is no capacity. <br />Commissioner Carruth also inquired about the number of apartment units <br />contained in each building. Ms. Watts advised that Mr. McCormick is more <br />knowledgeable on the specifics of the site plan for Mardan X. <br />Mark McCormick,. with B.J. McCormick Contracting, Inc., reported there <br />are 168 units proposed on the site with some of the buildings containing 12 <br />units and others housing 24 units. He also stated the proposed phasing <br />schedule is not conducive to this type of construction and presented the. <br />following build-out schedule for consideration: 120 units in 2008 and 96 <br />units in 2009. <br />Dan McCormick, with B.J. McCormick Contracting, Inc., also came forward <br />and addressed the Board. He said in the big picture there are approximately <br />600 available seats in this school district and that the purpose of the law <br />is to build where there are adequate facilities. He said a total of 46 <br />students will go to the elementary school, middle or high school; not just <br />the elementary school. He said this area was picked and property purchased <br />because it has adequate capacity. Based on preliminary conversations with <br />Cabarrus County staff, he said he was under the impression there was adequate <br />capacity; otherwise he would not have purchased the property. He said it was <br />determined that the facilities are not adequate after the property was <br />purchased. He also commented on "being stuck" with property that cannot be <br />developed and the unfeasibility of building an apartment complex over a five <br />or six-year period. <br />
