June 16, 2008 (Regular Meeting) <br />Page 873 <br />(G-3) Proposed Text Amendment to Chapter 8 0£ the Cabarrus County Zoning <br />Ordinance - C2008-01-ZT - Public Hearing - 6:30 p.m. <br />Susie Morris, Planning and Zoning. Manager, presented information <br />related to a proposed text amendment to Chapter 8 of the Cabarrus County <br />Zoning Ordinance C2008-O1-ZT that will allow Reception Facilities in the <br />Agricultural/Open Space and Countryside Residential Districts as a <br />Conditional Use. <br />Chairman White opened the public hearing at 7:49 p.m. The Public <br />Hearing Notice was published on May 29 and June 5, 2008 in THE INDEPENDENT <br />TRIBUNE and THE CHARLOTTE OBSERVER (CABARRUS NEIGHBORS). <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />UPON MOTION of Commissioner Mynatt, seconded by Commissioner Privette <br />and unanimously carried, the Board adopted the following Ordinance amending <br />the Cabarrus County Zoning Ordinance C2008-O1-ZT: <br />Ordinance No. 2008-10 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />Amend Chapter Two Rules of Construction and Definitions, Section 2-2, <br />Basic terms and definitions, as follows: <br />• ADD the following definition: <br />Reception Facilities <br />A fixed facility or establishment meant solely for banquets, <br />wedding receptions, recitals, corporate functions, non-profit <br />organization fund raisers, bar mitzvahs, anniversary celebrations <br />and the like; by reservation only, with food and beverage, brought <br />on site or prepared in an approved kitchen on site; but not as a <br />Bed & Breakfast (for a definition of Bed & Breakfast see page 2-3). <br />Entertainment scheduled in conjunction with the reserved events may <br />be permitted as an accessory activity of the use. A reception <br />facility shall not be operated as a restaurant with entertainment, <br />and cannot be used as such. <br />Amend Chapter Three, Establishment of Zoning Districts, Section 3-7, <br />Statements regarding the purpose of zoning districts, Uses in the Ag/0 <br />Zone, Conditional Uses as follows: <br />• DELETE the following language: <br />Aq/O Zone <br />• ADD the following language: <br />Agricultural/Open Space Zone <br />• ADD the following language to the list of Conditional Uses: <br />Reception Facilities <br />Amend Chapter Three, Establishment of Zoning Districts, Section 3-7, <br />Statements regarding the purpose of zoning districts, Uses in the <br />Countryside Residential Zone, Conditional Uses as follows: <br />• ADD the following language to the list of Conditional Uses: <br />Reception Facilities <br />Amend Chapter Eight, Conditional Uses, Section 8-4, <br />Conditional Uses: <br />RENUMBER the following uses: <br />Mobile Home Parks (from #27 to #10) <br />Multimedia Production & Distribution Complex (from #10 to #11) <br />Nurseries/Daycare Centers (from #11 to #12) <br />Public Service Facility (from #12 to #13) <br />Public Use Facility (from #13 to #19) <br />Race Complex (from #19 to #15) <br />Race Track, Animal/Mechanical (from #15 to #16) <br />Recreational Facility, Outdoor (from #16 to #18) <br />Religious Institution (351 seats or more) (from #17 to #19) <br />Religious Institution with School (from #16 to #20) <br />Rest/Convalescent Home (10 or more homes) (from #19 to #21) <br />Restaurant with Drive-Thru Facility (from #20 to #22) <br />
