June 16, 2008 (Regular Meeting) Page 878 <br />youth and families, and provide safe places for people to experience a sense <br />of community and create stronger social and family ties; and <br />Whereas, there is no second chance to protect the Carolinas' great resources <br />in this unique way for our children, grandchildren and great grandchildren, <br />and the cost of these invaluable resources will only increase in the future; <br />and <br />Whereas, private funding is available to communities from the Carolina Thread <br />Trail for planning and construction of regional trails, and this private <br />funding will leverage public funding from federal, state and various sources. <br />Now, Therefore, Be It Resolved that Cabarrus County supports the Carolina <br />Thread Trail and is committed in concept to working with neighboring <br />communities and with the Carolina Thread Trail to plan, design and build a <br />system of trails that will connect our communities, people and special <br />regional points of interest for years to come. <br />Adopted this the 16th day of June, 2008. <br />/s/ H. Jay White, Sr., Chairman <br />Cabarrus County Board of Commissioners <br />(G-7) Revised Consent Agreement - Rustic Canyon (Phases 1 6 2) Subdivision <br />Project <br />Susie Morris, Planning and Zoning Manager, presented information <br />related to the Rustic Canyon Subdivision Project. She stated this project <br />was approved in two separate phases with two separate consent agreements. <br />She requested the Board approve a consent agreement combining the existing <br />agreements so the Adequate Public Facilities Ordinance could be administered <br />effectively. She also reported that the developer has agreed to the <br />following proposed phasing schedule presented to the Board at the June Agenda <br />Work Session: <br />Calendar year 2008, no more than 100 lots platted; <br />Calendar year 2009, no more than 173 lots platted; <br />Calendar year 2010, no more than 176 lots platted; <br />Calendar year 2011, no more than 192 lots platted; <br />Calendar year 2012, no more than 199 lots platted; <br />Ms. Morris responded to questions from the Board. <br />Commissioner Carruth MOVED to approve the revised Consent Agreement <br />between Shea Homes, LLC and Cabarrus County for the Rustic Canyon (Phases 1 <br />and 2) Subdivision Project, as presented in the agenda. Commissioner Mynatt <br />seconded the motion. <br />Commissioner Privette stated his intent to vote against the motion <br />citing school capacity concerns. <br />The MOTION carried, with Chairman White, Vice Chairman Juba and <br />Commissioners Carruthand Mynatt voting for and Commissioner Privette voting <br />against. <br />L-S) Senate Bill 1597 Cary Energy Efficienay Incentive <br />John Day, County Manager, presented information regarding Senate Bill <br />1597, the Cary Energy Efficiency Incentive. He reported Senator Hartsell <br />asked if the County wants to be included in this legislation. The Bill <br />authorizes the approval of incentives in exchange for construction of new <br />development or reconstruction of existing development that reduces energy <br />consumption. <br />Commissioner Mynatt MOVED to ask the County's Legislative Delegation to <br />include Cabarrus County in Section 2 of Senate Bill 1597, the Cary Energy <br />Efficiency Incentive. Commissioner Carruth seconded the motion. <br />Commissioner Carruth commented on a new television show called <br />"Greensburg", which is about a town in Kansas that was destroyed by a tornado <br />that is utilizing energy efficiency measures in their rebuilding process. <br />The MOTION unanimously carried. <br />(G-9) Ware Bonsall Contraot Amendment #12 <br />
