June 16, 2008 (Regular Meeting) Page 884 <br />A RESOLUTION AUTHORIZING CONDEMNATION <br />TO ACQUIRE CERTAIN PROPERTY <br />WHEREAS, the Cabarrus County Board of Commissioners (the "Board") <br />hereby determines that it is both necessary and in the public interest to <br />acquire certain property which may be owned by those persons or entities <br />identified in Exhibit A (the "Properties".), for the following purpose: <br />To construct a new and additional elementary school and related <br />Facilities for the public education of the children of Cabarrus <br />County. <br />WHEREAS,. the proper officials or representatives of the Board have been <br />unable to acquire the needed interests in the Properties by negotiated <br />conveyance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD OF <br />COMMISSIONERS, that: <br />1. The Cabarrus County Board of Commissioners shall acquire by <br />condemnation, for the purposes stated above, the properties and interests <br />described in Exhibit A attached and incorporated by reference. <br />2. The Cabarrus County Attorney is directed to institute the <br />necessary proceedings under Chapter 40A of the North Carolina General <br />Statutes to acquire the Properties. <br />Adopted: This 16th day of June, 2008. <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br />BY: /s/ H.
