June 25, 2008 (Special Joint Meeting) Page 888 <br />The Board of Commissioners for the County of Cabarrus held a Special <br />Joint Meeting with the Concord City Council in the Multipurpose Room at the <br />Cabarrus County Governmental Center in Concord, North Carolina on Wednesday, <br />June 25, 2008, at 5:00 p.m. The purpose of the meeting was to review <br />revisions made to the Draft Eastern Area Land Use Map, and to discuss the <br />Consent Agreement and Interlocal agreement between Cabarrus County, the City <br />of Concord and the Water and Sewer District. <br />Present - Chairman: H. Jay White, Sr. <br />Vice Chairman: Joni D. Juba <br />Commissioners: Robert W. Carruth <br />Absent - Commissioners: Grace Mynatt <br />Coy C. Privette <br />Also present were John D. Day, County Manager; Kay Honeycutt, Clerk to <br />the Board; and Lori Hinson, Deputy Clerk to the Board. <br />Others present were Scott Padgett, Mayor; City Council Members Jim <br />Ramseur, David W. Phillips; Ella Mae Small, Alfred M. Brown, Jr., W. Lamar <br />Barrier, Hector H. Henry II, and Randy Grimes; Brian Hiatt, City Manager; <br />Albert M. Benshoff, City Attorney; and Kim Deason, City Clerk. <br />Call to Order <br />Chairman White called the meeting to order at 5:02 p.m. <br />Summary o£ Changes to Draft Eastern Area Land Use Ma <br />John Day, County Manager, reviewed changes made to the draft Eastern <br />Area Land Use Map since May 29, 2008. He detailed the following changes made <br />to the Land Use Map: the southwestern tip of the study area changed from <br />rural residential to very low density residential; an area along Crestmont <br />Drive has changed from rural residential to very low density residential; a <br />change from rural residential to very low density residential to an area <br />along Hess Road; and a change from rural residential to very low residential <br />to an area between Old SalisburyRoad and the Concord Middle School Site, and <br />between the school site and Gold Hill Road. He also reviewed features of an <br />agreement to establish a utility services boundary located within the area, <br />beyond which the City of Concord will not extend utilities or allow <br />developers to tap onto utilities except in the following occurrences: with <br />the permission of the Board of Commissioners; in cases of failing water or <br />wastewater systems; or for individual buildings adjacent to existing lines as <br />of June 30, 2008. He further reported that an open house is scheduled for <br />July 19, 2008 for the public to view the changes to the Land Use Plan and <br />that the County Planning Board and Concord Planning Board will each hold a <br />public hearing on the draft Central Area Land Use Plan and consider it for <br />adoption. <br />Note: Richard Koch, County Attorney, arrived at 5:08 p.m. and was <br />present for the remainder of the meeting. <br />Summary of Chances to Consent Agreement and Review of Interlocal Agreement <br />Albert Benshoff, City Attorney, presented a review of the second <br />amended .agreement and addressed the following topics: the first amended <br />agreement expires on June 30, 2008; the second amended agreement defines the <br />utility service boundary and incorporates the Interlocal Agreement. <br />Richard Koch, County Attorney, reviewed and clarified language and <br />terms of the Interlocal Agreement. He explained that the Consent Agreement <br />and Interlocal agreement contain overlapping information and the Interlocal <br />Agreement goes beyond the Consent Agreement in that it sets out exactly what <br />the City of Concord and Cabarrus County agree to with reference to the <br />implementation of the Central Area Plan once it is adopted. He stressed the <br />importance of information contained in paragraph 3 under the TERMS section of <br />the Interlocal Agreement, which defines where utilities will be provided by <br />the City of Concord. He further explained the following terms of the <br />agreement: the parties agree to the extension of utilities to many <br />developments in AREA A of the plan that are owned or operated by local <br />government or areas designated as employment centers; the parties will own <br />properties in AREA A of the plan in accordance with the Central Area Land Use <br />Plan once it is adopted; and the agreement will be for a 15 year term and <br />reviewed every five years to ensure its purposes are accomplished. <br />
