January 8, 2007 (Work Session) Page 217 The Board of Commissioners for the County of Cabarrus met for an Agenda Work Session in the Multipurpose Room at the Cabarrus County Governmental Center in Concord, North Carolina on Monday, January 8, 2007, at 3:30 p.m. Present - Chairman: Robert W. Carruth Vice Chairman: Joni D. Juba Commissioners: Grace M. Mynatt Coy C. Privette H. Jay White, Sr. Also present were John D. Day, County Manager; Richard M. Koch, County Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County Manager; and Kay Honeycutt, Clerk to the Board. Chairman Carruth called the meeting to order at 3:32 p.m. Closed Session to Consult with the County Attorney to Preserve the Attorney- Client Privilege, to Discuss Pending or Threatened Litigation and to Discuss a Personnel Matter(s) as Authorized by N.C. General Statute 143- UPON MOTION Vice Chairman Juba, seconded by Commissioner White and unanimously carried,~the Board moved to go into Closed Session to consult with the County Attorney to preserve the attorney-client privilege, to discuss pending or threatened litigation and to discuss a personnel matter(s) as authorized by N.C. General Statute 193-318.11(a)(3)(6). UPON MOTION of Commissioner Privette, seconded by Commissioner Mynatt and unanimously carried, the Board moved to come out of Closed Session. Cabarrus Arts Council Lease - Historic Courthouse Mike Downs, Deputy County Manager, presented a request from the Cabarrus Arts Council to amend its original lease agreement for the use of the Historic Courthouse to include an initial term of ten years (January 1, 2007 through December 31, 2016) and two automatic five year extended terms for a total of 20 years. In the 'original lease, he reported the Cabarrus Arts Council was required to make a minimum of $75,000.00 in improvements to the structure. He said the Council plans to make the following improvements that are at least four times that amount: the installation of new curtains, sound system, lighting system and track lighting; upfitting the auditorium with a new professional stage, and the creation of dressing and work rooms. He further reported the Council has raised a substantial amount of money to cover the renovations, however, some of the funds raised are contingent upon the Arts Council. being able to stay in the building longer. He said the lease is $1 per year. Mr. Downs responded to questions. UPON MOTION by Commissioner Privette, seconded by Commissioner Mynatt and unanimously carried, the Board voted to place the request by the Cabarrus Arts Council to amend its original lease for the use of the Historic Courthouse on the January 22, 2007 Agenda as a Consent item. Budget Amendment - Historic Courthouse Renovation Budget Jonathan Marshall, Commerce Director, reported the Cabarrus Arts Council received a grant from the Cannon Foundation to make improvements to the Historic Courthouse theater. He said the estimated cost of the improvements is $283,000.00 ($60,000.00 for the theatre and $223,000.00 for the rest of the improvements) and that bids were solicited for the project. He also reported the Cabarrus Arts Council has raised additional funds from private contributors, but is still $50,000.00 short. He presented the following options to the Board: (1) approve a budget ame~:dment to accept the funds raised privately by the Arts Council and move forward with as much of the remodeling project as possible; and (2) the County could add an additional $50,000.00 (equivalent to a 20 percent match) to the construction budget so all the construction could be completed in one cycle. Mr. Marshall responded to several questions. UPON MOTION of Commissioner Privette, seconded by Vice Chairman Juba and unanimously carried, the Board voted to place the following budget amendments related to the renovation of the Historic Courthouse on the January 22, 2007 Agenda as Consent items: (1) a budget amendment accepting the private donations from the Cabarrus Arts Council; and (2) a budget
