January 8, 2007 (Work Session) <br />Page 217 <br />The Board of Commissioners for the County of Cabarrus met for an Agenda <br />Work Session in the Multipurpose Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, January 8, 2007, at 3:30 p.m. <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />Commissioners: Grace M. Mynatt <br />Coy C. Privette <br />H. Jay White, Sr. <br />Also present were John D. Day, County Manager; Richard M. Koch, County <br />Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; and Kay Honeycutt, Clerk to the Board. <br />Chairman Carruth called the meeting to order at 3:32 p.m. <br />Closed Session to Consult with the County Attorney to Preserve the Attorney- <br />Client Privilege, to Discuss Pending or Threatened Litigation and to Discuss <br />a Personnel Matter(s) as Authorized by N.C. General Statute 143- <br />UPON MOTION Vice Chairman Juba, seconded by Commissioner White and <br />unanimously carried,~the Board moved to go into Closed Session to consult <br />with the County Attorney to preserve the attorney-client privilege, to <br />discuss pending or threatened litigation and to discuss a personnel matter(s) <br />as authorized by N.C. General Statute 193-318.11(a)(3)(6). <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Mynatt <br />and unanimously carried, the Board moved to come out of Closed Session. <br />Cabarrus Arts Council Lease - Historic Courthouse <br />Mike Downs, Deputy County Manager, presented a request from the <br />Cabarrus Arts Council to amend its original lease agreement for the use of <br />the Historic Courthouse to include an initial term of ten years (January 1, <br />2007 through December 31, 2016) and two automatic five year extended terms <br />for a total of 20 years. In the 'original lease, he reported the Cabarrus <br />Arts Council was required to make a minimum of $75,000.00 in improvements to <br />the structure. He said the Council plans to make the following improvements <br />that are at least four times that amount: the installation of new curtains, <br />sound system, lighting system and track lighting; upfitting the auditorium <br />with a new professional stage, and the creation of dressing and work rooms. <br />He further reported the Council has raised a substantial amount of money to <br />cover the renovations, however, some of the funds raised are contingent upon <br />the Arts Council. being able to stay in the building longer. He said the <br />lease is $1 per year. <br />Mr. Downs responded to questions. <br />UPON MOTION by Commissioner Privette, seconded by Commissioner Mynatt <br />and unanimously carried, the Board voted to place the request by the Cabarrus <br />Arts Council to amend its original lease for the use of the Historic <br />Courthouse on the January 22, 2007 Agenda as a Consent item. <br />Budget Amendment - Historic Courthouse Renovation Budget <br />Jonathan Marshall, Commerce Director, reported the Cabarrus Arts <br />Council received a grant from the Cannon Foundation to make improvements to <br />the Historic Courthouse theater. He said the estimated cost of the <br />improvements is $283,000.00 ($60,000.00 for the theatre and $223,000.00 for <br />the rest of the improvements) and that bids were solicited for the project. <br />He also reported the Cabarrus Arts Council has raised additional funds from <br />private contributors, but is still $50,000.00 short. He presented the <br />following options to the Board: (1) approve a budget ame~:dment to accept the <br />funds raised privately by the Arts Council and move forward with as much of <br />the remodeling project as possible; and (2) the County could add an <br />additional $50,000.00 (equivalent to a 20 percent match) to the construction <br />budget so all the construction could be completed in one cycle. <br />Mr. Marshall responded to several questions. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Juba <br />and unanimously carried, the Board voted to place the following budget <br />amendments related to the renovation of the Historic Courthouse on the <br />January 22, 2007 Agenda as Consent items: (1) a budget amendment accepting <br />the private donations from the Cabarrus Arts Council; and (2) a budget <br />
