April 2, 2007 (Work Session) <br />Page 330 <br />Chairman Carruth read an e-mail from Representative Barnhardt <br />explaining the premise behind the bill. <br />There was a discussion on due process rights. <br />Richard M. Koch, County Attorney, explained how imminent domain works <br />based on Chapter 96 and pointed out the Transportation Department uses <br />Chapter 136. He said there are variations in the law between the two <br />chapters. <br />Commissioner Privette asked if the County Attorney would research the <br />bill and report back to the Board at the April regular meeting. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Juba <br />with Chairman Carruth, Vice Chairman Juba and Commissioners Mynatt and <br />Privette voting for and Commissioner White voting against, the Board voted to <br />place House Bill No. 1002 - Cabarrus Quick-Take on the April 26, 2007 Agenda <br />as a New Business item. <br />Senate Sill 1412 (TIFDiatricta - UP Zonea) 6 Other Legislation <br />John D. Day, County Manager, reported on SB 1912 - an act to eliminate <br />a provision dealing with revisions to the base valuation in development <br />financing districts and to revise urban progress zones. <br />There was a brief discussion on the proposed bill. <br />Mr. Day also commented on other legislation that governs industrial <br />development bonds. <br />Steve Cordell, the County's Bond Counsel, reported this legislation is <br />not for the North Carolina Research Campus. <br />Senate Sill 1409 and 1444 <br />John D. Day, County Manager, reported on Senate Bills 1909 and 1994, <br />sponsored by Senator Hartsell and the potential impact on the County's <br />budget. SB 1909 provides a special separation allowance for career <br />firefighters and rescue squad workers. SB 1449 is an act to allow law <br />enforcement officers who are members of the Teachers' and State Employees' <br />Retirement System to retire with unreduced benefits after completing twenty- <br />five years of service and to amend the special separation allowance benefit <br />for law enforcement officers. <br />Adjourn <br />UPON MOTION of Commissioner White, seconded by Commissioner Mynatt and <br />unanimously carried, the meeting adjourned at 7:55 p.m. <br />r ~.n.., <br />Clerk o t e Bo r <br />
