June 18, 2007 (Regular Meeting) <br />Page 425 <br />contributors to the wastewater treatment system, through the issuance of <br />permits to certain non-domestic users and through enforcement of general <br />requirements for the other users, authorizes monitoring and enforcement <br />activities, requires user reporting and provides for the setting of fees <br />for the equitable distribution of costs resulting from the program <br />established herein. <br />(d) This ordinance shall apply to all users of the wastewater treatment <br />system, as authorized by N.C.G.S. 160A-312 and/or 153A-275. WSACC shall <br />desianate an administrator of the POTW_and pretreatment program hereafter <br />' referred to as the Executive Director. Except as otherwise provided <br />herein, the Executive Director shall administer, implement, and enforce <br />the provisions of this ordinance and shall be responsible for operating <br />and maintaining the wastewater treatment system. Any powers granted to or <br />imposed upon the Executive Director may be delegated by the Executive <br />Director to other WSACC personnel. By discharging wastewater into the <br />wastewater treatment system, industrial users located outside WSACC <br />'n..^~ service area agree to comply with the terms and conditions <br />established in this ordinance, as well as any permits, enforcement <br />actions, or orders issued hereunder. <br />1.2 Definitions a "`^-^ '` ..~ <br />Unless the context specifically indicates otherwise, the following terms and <br />phrases, as used in this ordinance, shall have the meanings hereinafter <br />designated: <br /> (1) Act or the Act. ^`^'~-,..ea-,= The Federal Water Pollution Control Act, <br /> also known as the Clean Water Act, as amended, 33 U.S.C. 1251. et. <br /> seq. <br /> (2) Approval Authority. ^'~,'~'~^"^"^ The Director of the Division of <br /> Water Quality ^"~~' Fanagement of the North Carolina <br /> Department of Environment,- :~^,'a and Natural Resources or his <br />' designee. <br /> (3) Authorized Representative of the Industrial User: <br /> (i) If the industrial user is a corporation, authorized <br /> representative shall mean: <br /> a) the president, secretary, or a vice-president of the <br /> corporation in charge of a principal business function, <br /> or any other person who performs similar policy or <br /> decision-making functions for the corporation, or <br /> b) the manager of one or more manufacturing, production, <br /> or operation facilities provided, the manager is <br /> authorized to make management decisions which govern <br /> the operation of the regulated facility including <br /> having the explicit or implicit duty of making major <br /> capital investment recommendations, and initiate and <br /> direct comprehensive measures to assure long-term <br /> environmental compliance with environmental laws and <br /> regulations• can ensure that the necessary systems are <br /> established or actions taken to gather complete and <br /> accurate information for control mechanism <br /> requirements; and where <br />,ocn~ ~--. _i <br />~'P <br />` <br />"^ <br />^ <br />~ <br />d'~ <br />"' <br /> -j~ <br />.. <br />. <br />T <br />y <br />eS E3Eeee <br />Fl <br />ea ee Br e3Epen <br />ER1 ~i- ids ~s f ~ n seee~nd gaa~te- ' °8B de" ars) ' ° <br />authority to sign documents has been assigned or <br />' delegated to the manager in accordance with corporate <br /> procedures. <br /> (ii) If the industrial user is a partnership or sole <br /> proprietorship, an authorized representative shall mean a <br /> general partner or the proprietor, respectively. <br /> (iii) If the industrial user is a Federal, State or local <br />government facility, an authorized representative shall mean <br />a director or highest official appointed or designated to <br />
