June 18, 2007 (Regular Meeting) Page 475 <br />inconsistency or conflict. <br />SECTION 21 - PUBLIC NOTIFICATION OF UNTREATED WASTE AND <br />WASTEWATER DISCHARGES <br />(a) All wastewater spills that reach the surface waters (regardless of <br />volume) and all spills to the ground surface exceeding 1,000 gallons <br />(re gardless of whether they are contained or reach surface waters) should <br />be reported by the discharger to the State's Department of Environment <br />and Natural Resources regional office. <br />(b) Whenever a discharge of untreated wastewater of 1;000 gallons or more <br />reaches surface waters a press release must be sent by the discharger to <br />all print and electronic news media providing general coverage in the <br />county where the discharge occurred. The press release is to be issued <br />within 98 hours of the determination that the wastewater has reached <br />surface waters. A copy of the press release and a list of the media to <br />which it was distributed must be kept on file by the user for at least <br />one year and copies made available upon request. <br />(c) If the untreated discharge to the surface waters is 15,000 gallons or <br />more the discharger must issue a press release and a notice of the <br />discharge must be published in a newspaper with general circulation in <br />the county where the discharge occurred and in each county downstream <br />that is significantly affected. The Secretary of the Department of <br />Environment and Natural Resources determines which counties are <br />significantly affected and publication must occur within 10 days of this <br />determination and DENR's approval of the form and content of the notice <br />and the newspapers in which it is to be published. <br />' This ordinance shall be in full force and effect from and after its approval, <br />adoption and publication, as provided by law. <br />Adopted this day of 2007. <br />WATER AND SEWER AUTHORITY OF <br />CABARRUS COUNTY <br />CHAIRMAN, Board of Directors <br />ATTEST: <br />(seal) <br />APPROVED AS TO FORM: <br />WSACC Attorney <br />(G-5) Ware Honsall Contract Amendment #10 <br />Mike Downs, Deputy County Manager, reported Contract Amendment No. 10 <br />' addresses housekeeping changes in the language to make the appropriate <br />references to the use of a Construction Manager at Risk contract instead of <br />the single prime bid process. Note: There was no additional cost associated <br />with this contract amendment. <br />County Manager John Day pointed out these changes have been reviewed <br />and approved by the County Attorney. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner White with <br />Chairman Carruth, Vice Chairman Juba and Commissioner White voting for and <br />Commissioner Privette voting against, the Board approved Ware Bonsall <br />Contract Amendment #10. <br />
