There was further discussion. <br />Commissioner White withdrew his MOTION to table Consent Agreement for <br />the Mills at Rocky River subdivision project. Vice Chairman Juba withdrew <br />her second. <br /> Commissioner White made a MOTION to approve the Consent Agreement <br /> between Cabarrus County and Crosswinds at Rocky Rive r, LLC c/o Grace <br /> Development Corporation, LLC for The Mills at Rocky River subdivision <br /> project, including the payment of $9,039.00 per lot to advance school <br /> adequacy and a build-out schedule of no more than 61 lots platted in 2007, on <br /> the condition that an independent appraiser be selected a nd approved by both <br /> parties by June 30, 2007 . He further moved to authorize the County Manager <br /> to execute the Agreement . on behalf of Cabarrus County. <br />Vice Chairman Juba seconded the MOTION. <br />Commissioner Privette commented on the lack of adequate school capacity <br />for this project. <br />The MOTION carried with Chairman Carruth, Vice Chairman Juba and <br />Commissioner White voting for and Commissioner Privette voting against. <br />(G-10) Consent Agreement - Mountain Brook Phase 6 <br />Kassie G. Watts, Planner, presented a Consent Agreement for Mountain <br />Brook Phase 6 subdivision. She reported the subdivision, developed by MDP <br />Custom Homes, Inc., was approved by the City of Concord Planning and Zoning <br />Board on December 12, 2006; consists of 8 single family lots on +/- 27.12 <br />acres and is located on Stacybrook Drive SE. She further reported the <br />Agreement includes the payment of $9,039.00 per lot to advance school <br />adequacy which is due at final platting; and only the elementary school is <br />t over capacity. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner White <br />and carried unanimously, the Board approved the Consent Agreement between <br />Cabarrus County and MDP Custom Homes, Inc., for Mountain Brook Phase 6 <br />subdivision, including the payment of $4,039.00 per lot to advance school <br />adequacy due at final platting and a build-out schedule of no more than eight <br />lots platted in 2007. Further, the Board authorized the County Manager to <br />execute the Agreement on behalf of Cabarrus County. <br />(G-11) Resolution of Support for the Clean Water Act of 2007 <br />UPON MOTION of Vice chairman Juba, seconded by Commissioner White, and <br />unanimously carried, the Board adopted the following resolution: <br />Resolution No. 2007-13 <br />Resolution of Support for the Clean Water Act of 2007 <br />WHEREAS, North Carolina's continued prosperity depends on protecting the <br />State's water resources for current use and future generations; and, <br />WHEREAS, North Carolina is expected to grow by 3.5 million people to exceed <br />12 million by the year 2030, placing pressures on the State's water resources <br />and local water providers; and, <br />WHEREAS, North Carolina's businesses, traditional and emerging industries all <br />' depend on reliable supplies of clean water, reasonable utility costs, well <br />maintained water infrastructure and an attractive natural environment; and, <br />WHEREAS, the 1998 Clean Water Bonds delivered significant benefits to North <br />Carolina communities and citizens, supporting 1,103 projects in 97 counties, <br />which <br />• Helped create or retain 92,000 jobs <br />• Corrected major regulatory violations in 97 communities <br />• Addressed failing septic systems and contaminated wells in 59 counties <br />• Resulted in 50 communities receiving sewer service fcr the first time <br />• Encouraged regional efficiencies, sound planning and conservation <br />practices; and, <br />
