October 1, 2007 (Work Session) Page 568 <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place the Consent Agreement for The <br />Mills at Rocky River subdivision on the October 15, 2007 Agenda as a New <br />Business item. <br />Consent Agreement - Rustic Canyon (Phase 2) Subdivision <br />Kassie G. Watts, Planner, presented a Consent Agreement for Phase 2 of <br />the Rustic Canyon Subdivision that was approved by the Cabarrus County <br />Planning and Zoning Board on June 21, 2007, consists of 236 single family <br />lots on +/- 159.19 acres and is located on Zion Church Road. She reported <br />the Board tabled its consideration of the Consent Agreement in August and <br />asked staff to work with the developer on a revised build-out schedule. The <br />revised schedule is as follows: no more than 50 lots to be platted in 2009, <br />no more than 50 lots to be platted in 2010, no more than 50 lots to be <br />platted in 2011 and no more than 86 lots to be platted in 2012. She further <br />reported the Consent Agreement includes the payment of $9,039.00 per lot (due <br />at final platting) to advance school adequacy and that the Board had already <br />approved a Consent Agreement for 997 lots on March 26, 2007 for Phase 1. <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place the Consent Agreement for <br />Rustic Canyon Subdivision (Phase 2) on the October 15, 2007 Agenda as a New <br />Business item. <br />Additional Items for the Agenda <br />John Day, County Manager, distributed and reviewed the following list <br />of additional items for the October agenda: <br />Recognition & Presentations: <br />• Proclamation Declaring October 30th as Weatherization Day in Cabarrus <br />County <br />• Recognition of County Government 101 Fall Class of 2007 <br />Old Business: <br />• Ware Bonsall Architects - Contract Amendment No. 11 <br />• Report by the County Attorney on Possible Actions with Regard to <br />Commissioner Privette <br />Consent: <br />• Refund and Release Reports - September 2007 <br />• Approval of Renewal Contract with Lutheran Family Services in the <br />Carolinas for Foster Care Services <br />• Department of Aging - Centralina Council of Governments, Home & <br />Community Care Block Grant <br />• Addition to List of Brokers to Obtain Quotes for Investments Purposes <br />as Required by G.S. 159-31 <br />• Set Public Hearing Date for Approval of the New Flood Plain Maps and <br />Revised Flood Plain Ordinance <br />Appointments: <br />• Cabarrus Planning & Zoning Commission (alternate position) <br />• Others - to be determined <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to add a public hearing relating to the <br />sale of the former First Union Bank Building on the October 15, 2007 Agenda <br />as a New Business item. <br />John D. Day, County Manager, responded to questions on the <br />aforementioned list. <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place the aforementioned items on the <br />October 15, 2007 Agenda as presented. <br />Closed Session <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to go into Closed Session to discuss <br />matters relating to the location or expansion of industries or other <br />businesses served by the public body as authorized by North Carolina General <br />Statute 143-218.11(a)(4). <br />
