<br />Vice Chairman Juba MOVED to approve the Consent Agreement between
<br />Cabarrus County and Crosswinds at Rocky River, LLC c/o Grace Development
<br />Corporation, LLC for The Mills at Rocky River subdivision, including payment
<br />of $9,039.00/$1,331.00 per single Family lot/unit due at final platting to
<br />advance school adequacy, to allow the developer a credit of $99,000.00 per
<br />acre against the school adequacy fee if developer donates the agreed upon
<br />school site and the following build-out schedule of no more than 163 dwelling
<br />units platted in 2007, no more than 200 dwelling units platted in 2008, no
<br />more than 150 dwelling units platted in 2009, no more than 150 dwelling units
<br />platted in 2010, no more than 200 dwelling units platted in 2011, no more
<br />than 100 dwelling units platted in 2012 and no more than 176 dwelling units
<br />platted in 2013. She also MOVED to authorize the County Manager to execute
<br />the Consent Agreement on behalf of Cabarrus County.
<br />Commissioner White seconded the motion.
<br />Commissioner Privette expressed opposition to approving the Consent
<br />Agreement and read an excerpt from an article recently published in THE
<br />CHARLOTTE OBSERVER about the rapid growth in Cabarrus County.
<br />After further discussion, the MOTION carried with Chairman Carruth,
<br />Vice Chairman Juba and Commissioners Mynatt and White voting for and
<br />Commissioner Privette voting against.
<br />(G-10) Consent Agreement - Pendleton Subdivision
<br />Kassie Watts, Planner, reported the Pendleton subdivision, developed by
<br />Pendleton/Concord Partner, LLC was approved by the Concord Planning and
<br />Zoning Board on May 15, 2007 and consists of 88 single family residential
<br />lots and 90 multi-family townhome units on +/-80.3 acres located on Crestmont
<br />Drive. The Consent Agreement includes the payment of $9,039.00 per single
<br />family lot (due at final platting) and $1,331.00 per multi-family unit (due
<br />prior to building permitting) to advance school adequacy and the following
<br />build-out schedule: Calendar year 2008, no more than 29 multi-family
<br />townhome unit building permits will be issued and no more than 20 single
<br />family lots will be platted; Calendar year 2009, no more than 24 multi-family
<br />townhome unit building permits will be issued and no more than 20 single
<br />family lots will be platted; Calendar year 2010, no more than 24 multi-family
<br />townhome unit building permits will be issued and no more than 20 single
<br />family lots will be platted; Calendar year 2011, no more than 18 multi-family
<br />townhome unit building permits will be issued and no more than 20 single
<br />family lots will be platted; Calendar year 2012, no more than 6 single family
<br />lots will be platted. Finally, she reported Kerry Watts, a representative
<br />for the developer, is present to respond to questions from the Board.
<br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt and
<br />unanimously carried, the Board approved the Consent Agreement between
<br />Cabarrus County and Pendleton/Concord Partner, LLC for the Pendleton
<br />subdivision, including the payment of $4,034.00 per single family lot with
<br />payment due at final platting and payment of $1,331.00 per multi-family unit
<br />with payment due prior to building permitting to advance school adequacy and
<br />the Following build-out schedule: Calendar year 2008, no more than 29 multi-
<br />family townhome unit building permits will be issued and no more than 20
<br />single family lots will be platted; Calendar year 2009, no more than 29
<br />multi-family townhome unit building permits will be issued and no more than
<br />20 single family lots will be platted; Calendar year 2010, no more than 24
<br />multi-family townhome unit building permits will be issued and no more than
<br />20 single family lots will be platted; Calendar year 2011, no more than 18
<br />multi-family townhome unit building permits will be issued and no more than
<br />20 single family lots will be platted; Calendar year 2012, no more than 8
<br />single family lots will be platted. By the same vote, the Board also
<br />authorized the County Manager to execute the Agreement on behalf of Cabarrus
<br />County.
<br />- Crescent Circle at Concord Mills Multi
<br />Kassie Watts, Planner, reported the Crescent Circle at Concord Mills
<br />Multi-Family Apartment Project, developed by Crescent Resources, LLC, was
<br />approved by the Concord Planning and Zoning Board on January 17, 2007 and
<br />consists of 629 multi-family apartment units on +/-108.0693 acres located on
<br />Thunder Road. The Consent Agreement includes the payment of $1,331.00 per
<br />multi-family apartment unit to advance school adequacy (to be paid in full
