October 15, 2007 (Regular Meeting) Page 584 <br />There was no one else present to address the Board; therefore, Chairman <br />Carruth closed the public hearing. <br />Vice Chairman Juba MOVED to approve the Agreement for Purchase and Sale <br />between Salloum Ventures, LLC and Cabarrus County for Parcel Identification <br />No. 5620972799, 5620973931 and 5620983000 being commonly known as the former <br />Cabarrus Bank and Trust building including the associated drive through <br />facility and parking areas. <br />Commissioner Privette seconded the motion. <br />Commissioner White requested the date of September 28, 2007 as <br />identified in paragraph No. 29 of the Agreement be verified. <br />Mr. Koch reported the document that will be executed will contain an <br />updated date. It was noted the updated date will be October 19, 2007. <br />Vice Chairman Juba amended her MOTION to include authorizing the County <br />Manager to execute the appropriate document for sale. <br />Commissioner Privette seconded the amended motion. <br />The amended MOTION unanimously carried. <br />Recess o£ Meeting <br />Chairman Carruth called for a short recess at 8:03 p.m. The meeting <br />reconvened at 8:18 p.m. <br />Chairman Carruth then moved item G-7 (Locust Subdivision - Adequate <br />Public Facilities Ordinance Alternative) to the next item on the agenda. <br />(G-7) Locust Subdivision - Adequate Public Facilities Ordinance Alternative <br />Chairman Carruth commented on the annexation of property into Cabarrus <br />County along the Rocky River and Highway 29/27 by the City of Locust, in <br />particular a subdivision named, The Villages at Red Bridge. He stated there <br />are no plans for the County to build schools in this area and that part of <br />the subdivision is actually located in Stanly County. He asked if the <br />subdivision approval date had been determined. <br />John Day, County Manager, reported there has been some lack of <br />agreement and clarity of the subdivision approval dates by the Locust <br />Planning Board and City Council. Next, he presented the concept of <br />redistricting students to allow them to attend Stanly County Schools as a <br />possible alternative to the Adequate Public Facilities contribution and <br />commented on the uniqueness of the situation. <br />There was a lengthy discussion and Mr. Day responded to several <br />questions from the Board. Issues. addressed included the following: how does <br />the Locust school situation differ from Kannapolis; pros and cons of the <br />concept; legalities; determining the appropriate contribution for school <br />adequacy in a timely manner; etc. <br />Chairman Carruth stated he thought it is appropriate to direct staff to <br />contact the affected parties to begin discussions on the concept of <br />redistricting. <br />Commissioner White disclosed that his employer, the law firm of <br />Hartsell and Williams, P.A., represents the City of Locust. He expressed <br />concern about participating in the policy discussion and stated his intent to <br />not vote on any issue related to the City of Locust. <br />Richard Koch, County Attorney, advised Commissioner White that since <br />the Board is discussing a policy issue, there is no conflict. <br />After further comments, Commissioner Mynatt MOVED to direct staff to <br />look into the possibility of creating a policy for residents in the Locust <br />area to attend Stanly County schools. <br />Commissioner Privette seconded the motion. <br />Commissioner White asked if he needed to recuse himself from the vote. <br />Mr. Koch responded that he did not. <br />
